b. Review and discussion of Draft Poultry Regulation. Mr. Harrington stated that, in 2011, the <br /> health agents presented a draft regulation to the Board to address poultry(chickens)in Mashpee. <br /> Linder the law, Boards of Health must have all agricultural regulations reviewed by the local <br /> agricultural commission. Mr. Harrington stated that roosters are the main Issue of concern in <br /> bringing this before the Board, particularly due to the fact that the Health office had encountered <br /> first refusal to cooperate with removal of roosters as a noise nuisance. The Town's noise by-law <br /> Is so vaguely written that the Board needs another option to enforce roosters. It Is Mr. <br /> Harrington's opinion that a Board regulation would be more effective than a Town By-law, and <br /> that the Health Department should maintain a registration of residences and farms with backyard <br /> chicken populations. He Informed the Board that he had started an Informal list based upon <br /> voluntary Information as well as noise complaints, and recommended that, to be fair, all other <br /> aspects of poultry need to be reviewed for the draft regulation because It Is a comprehensive <br /> regulation, <br /> Mr, Harrington stated that, at this time, inspections are not conducted for backyard chickens, <br /> even though the USDA includes poultry Inspections in its livestock requirements. The Assistant <br /> Health Agent is also the State Animal Inspector, and Inspection of the properties with chickens <br /> should be conducted. Ms. Langler inquired about the frequency of rooster complaints, and Mr. <br /> Harrington answered about two a year. The Board discussed the definition of"poultry" under <br /> the regulation. Ms, Langler Inquired If enforcement would be complaint driven, and Mr, <br /> Harrington stated that it was more about getting on the property to do annual inspections that <br /> would ensure compliance,and also address any underlying issues such as rats. A local regulation <br /> would ensure that residents with chickens register annually and, therefore, could expect an <br /> annual visit from a health agent. <br /> The Board agreed to continue discussion on this matter. <br /> 7. Review and discussion of Draft Innovative Alternative Septic Regulation, No discussion. <br /> NEXT MEETING <br /> The next meeting of the Board of Health was scheduled for November 29,2018 at 7:00 PM. <br /> There being no further business, Mallory Langler moved to adjourn the Pubic Session Meeting of the <br /> Board of Health at 5:37 PM.
