Mr. Ballou stated that retailers <br /> have already seen the impact in sales due to the minimum age going up to 21, He also asked for <br /> clarification on Paragraphs B and g of Section 8, which seemed to state that if a permit is not renewed <br /> because a retailer closes their business, that particular permit gets pulled out of pool, Mr. Harrington <br /> explained that,if the retailer is occupying the same geographical location,the permit can be reissued. He <br /> further stated that he would revise the language of the regulation to nail that down, Mr. Ballou closed by <br /> asking the Board to think carefully whether limiting the types of tobacco products sold to adults was really <br /> achieving their goal of reducing teens and young adult tobacco use, <br /> Sarah McColgan, Director of Tobacco Control Program for Mass Health Officers Association, introduced <br /> herself and stated that she wished to speak in favor of regulation. She stated that this is not just about <br /> sale of products to minors, about tobacco products in general, and the danger of another generation <br /> becoming addicted to nicotine, Ms. McColgan advised the Board that youth use of combustible products <br /> went way down but then the phenomenon of vaping products were introduced. She stated that <br /> adolescents are vaping mintJuuls more than they would be smoking cigarettes,and that youth who would <br /> have no interest in combustible cigarettes will begin vaping because they believe It Is not dangerous. Ms. <br /> McColgan stated that 1.23 municipalities have put in the flavored restriction, and it is currently being <br /> discussed at the state level, but the flavored tobacco fight could take several Years. <br /> Saeed Chaudry, owner of Commons Convenience, Introduced himself and stated that he already loses a <br /> lot of business to Cotult and Hyannis,and this could harm his business even more. Matt Pierson,manager <br /> of AIITown Mobile, introduced himself and said that the state should get tougher on Inspections rather <br /> than limit the sale of tobacco products. Mr. Pierson stated that his employees watch a training video on <br /> tobacco every three months and they are instructed to card everyone. <br /> The Nurse Coordinator for Mashpee Schools,Stacey Schakel,introduced herself and stated that the goal <br /> continues to be education. Parents and students need to understand the Impact of tobacco products and <br /> that they remain an unhealthy choice, Chairman Baumgaertel asked-if combustibles are In fact on the <br /> decrease and vaping use on the rise, and Ms. Schakel answered In the affirmative. She stated that the <br /> popularity of vapes and Juuls is a step backwards,and indicated her concern that,in 5-10 years,users will <br /> go back to combustibles, Ms.Schakel Informed the Board that the school has a strict tobacco policy with <br /> discipline involved, as well as teaching tools for students who are found to be using tobacco products. <br /> She is of the opinion that any flavored tobacco product Is a marketing tool to young people. Chairman <br /> Baumgaertel asked what kinds of products were being confiscated and if they were predominantly <br /> flavored, and Ms. Schakel answered hooka pens, Juuls and vapes, and everything they confiscate is <br /> flavored and easy to hide due to their design. Ms.Schakel closed by mentioning the dangers of giving gift <br /> cards to teenagers, as they are frequently used for online purchases of tobacco products. <br /> At that point, Chairman Baumgaertel closed the public comment portion of meeting. Mr. Harrington <br /> stated that he would come up with wording on the"transfer"of permits. He informed the Board that our <br /> office did receive two other written comments regarding the potential loss of retail business. Ms. Langler <br /> thanked everyone for coming, and reminded the audience that the intent of the regulation is not to hurt <br /> retailers, but in the Interest of public health. She stated that she does not agree with the comparison <br /> between tobacco and alcohol,as flavored nips are not used in schools but flavored tobacco is. <br /> Chairman Baumgaertel asked, in cases where towns chose not to regulate flavored tobacco, have any <br /> alternatives been put into place,and Mr.Collett answered that towns were either addressing the issue or <br /> they were not. Mr. Collett recommended that the Board look at an implementation date of December <br /> 28t", stating that It has to go into effect before December 30, 2018, otherwise preemptive language in <br /> 3 <br />
