<br />Conservation Commission Minutes <br />Thursday, August 23, 2018 <br />Mashpee Town Hall <br />Waquoit Meeting Room <br /> <br />Present: Dale McKay, Tom O’Neill, Brad Sweet, Charles Dalton, Marty Bregman <br />(alternate) <br /> <br />Also Present: Andrew McManus (Conservation Agent), and Judy Daigneault <br />(Recording Secretary) <br /> <br />CALL MEETING TO ORDER: 5:55 p.m. <br /> <br />PRE/POST-HEARING AGENDA: <br /> <br />Public: No comments <br /> <br />Minutes: Approve August 7, 2018 Minutes – Hold <br /> <br />Update: Abutter appeal of ORAD – Gooseberry Island <br /> <br />The Agent informed the Commissioners that both the abutters and the Tribe filed appeals <br />of ANRAD regarding Gooseberry Island which should not be discussed at this meeting. <br />The grounds are a lack of showing the two resources areas that weren’t acknowledged on <br />the plan of record: land containing shellfish and land under ocean around the island. They <br />are also disputing the delineating of flood zone and the delineation of coastal bank <br />claiming we weren’t recognizing coastal flats and a small area of coastal dune that was not <br />part of the ANRAD. The next step is for DEP to schedule a superseding onsite hearing. <br />They send a State reviewer to meet with Conservation staff, Conservation Commissioners, <br />abutters and all representatives of both parties. They get testimony and the reviewer goes <br />back and comes up with a superseding decision. <br /> <br />Update: Mitigation Regulation 12 Review <br /> <br />The Agent requested that the Commissioners review Mitigation Regulation 12 because he <br />will be reviewing the regulation to make the language more concise. He said he would like <br />to include the chart used for the mitigation calculation for a reference point when it comes <br />to mitigation in general…in addition to a waiver request reference. He said if the <br />Commissioners have any ideas to let him know and this can be discussed at a future <br />meeting. <br /> <br />Public - None <br /> <br /> <br /> <br /> <br />
