Mr. Mann, homeowner, was asking to take down a dead tree and do some pruning on his
property. He noted the area on photos. The Agent stated the Assistant Agent went out
and deemed the tree to be a hazardous tree and noted on the photos trees that needed
pruning due to the proximity to the house. He said there is no need to get rid of the dead
brush because it helps stabilize the bank and provides good habitat features.

No comment from the public

Motion: Mr. Smith moved a Negative Determination, seconded by Mr. Sweet. Vote
unanimous 4-0

6:30 Richard E. & Ann L. Marvas, 67 Riverside Road. Proposed
demolition/reconstruction of single-family dwelling, tree and invasive plant removal
and mitigation plantings. NOI

Resource Area: LSCSF, Buffer Zone to Coastal Bank, ACEC, Land Containing
Shellfish, Land Under Ocean, Hamblin Pond

Tom Bunker, BSS Design, represented the applicants. He stated previously the
Commission approved a septic system 18 years ago which was approved and installed for
a two bedroom house. The owners now want to rebuild the house into a 3 bedroom
house. The house is larger and 11 feet closer to the pond. He reviewed the proposed
work on the plan provided. The trees are fairly close to the work and some may be taken
down and the others will be protected. He will be removing the invasive plants. The Agent
noted the Board of Health signed off for a 3 bedroom house. He noted a list of plantings
were not included. Mr. Bunker will work with the Agent on the mitigation plan.

No comment from the public

Motion: Mr. Smith moved to Close and Issue with the condition Mr. Bunker works
with the Conservation Agent to develop a mitigation plan, seconded by Mr. Sweet.
Vote unanimous 4-0

6:33 Marilyn C. & Gale M. Sinkiewicz, 170 Captains Row. Proposed
demolition/reconstruction of pier, ramp and floats.
