<br /> <br /> <br />Conservation Commission Executive Session Minutes <br />Thursday, September 13, 2018 <br />Mashpee Town Hall <br />Waquoit Meeting Room <br /> <br />Commissioners Present: Dale McKay, Thomas O’Neill, Chad Smith, Charles Dalton, <br />Stephanie Simpson (Associate Member) and Marty Bregman (Associate Member) <br /> <br />Also Present: Andrew McManus, Conservation Agent, Katelyn Cadoret, Assistant <br />Conservation Agent and Judy Daigneault, Recording Secretary <br /> <br />EXECUTIVE SESSION: Discussion Gooseberry Island <br /> <br />The Agent stated the Order of Resource Area Delineation (ORAD) for Gooseberry Island <br />by the Conservation Commission has been appealed by the abutters and the Tribe. He <br />said they both submitted individual appeals but the Department of Environmental <br />Protection will be handling it as one appeal from both parties. The State will deliberate by <br />organizing a meeting at the site. The DEP reviewer will then assess the input of all <br />involved parties. DEP can uphold the Conservation Commission’s ORAD or they can <br />issue a superseding ORAD or require additional information from the applicant. <br /> <br />He said the question is whether or not we should have legal counsel going forward in this <br />matter. He said if the State issues a superseding ORAD, no matter what the outcome, it is <br />going to result in either an agreement with the Conservation Commission or a requirement <br />of the applicant to submit more information. He recommended there is no reason to <br />request the assistance of town counsel in this matter because the outcome of this matter is <br />either an approval of the Commission ORAD or additional requirements of the applicant. <br />The Commissioners agreed with the Agents recommendation. <br /> <br />Motion: Mr. Smith moved to Close the Executive Session and not return to open <br />session. Seconded by Mr. Dalton. Roll Call Vote: Mr. Smith, yes; Mr. O’Neill, yes; <br />Mr. Dalton, yes; Mr. McKay, yes: Vote unanimous 4-0 <br /> <br />Meeting adjourned 8:35 p.m. <br /> <br />Respectfully Submitted, <br /> <br />Judy Daigneault <br />Recording Secretary <br /> <br />
