Attached for your information is a filing made today by CLF, the Buzzards Bay <br /> Coalition and EPA as parties to the federal lawsuit concerning the Clean Water Act. As you <br /> will see from the joint motion, the court parties have jointly agreed to pursue settlement <br /> through a mediated process and have agreed upon a set of filing requirements to to <br /> effectively stay the prosecution of the suit for up to 90 days to allow the mediation to <br /> proceed. <br /> The state and county have been invited to participate as interested parties in the <br /> mediation. We have both agreed to do so as both non-court parties have an interest in the <br /> outcome of any settlement between the parties. <br /> The filing does indicate the likelihood that the plaintiffs will perfect their service on <br /> the County pursuant to the notice to sue received last August.
