Mr. Balzwini questioned who would have the <br /> final say if the Board wishes to Dire a consultant and Mr. Fudala responded that the Town Bylaw states that the <br /> Planning Board may engage a consultant but that the Town Charter requires the Town Manager to sign the <br /> contract. Board members noted that all parties must agree in order to move forward. Mr. Storrs stated that the <br /> Planning Board has a right to hire a consultant. There was further discussion regarding the approval process <br /> should the Board wish 6 hire a consultant. Selectman Richardson stated that if the Board is in agreement that a <br /> consultant is needed, he would support it. Mr. Rowley recommended leaving wiggle roam in the agreement in <br /> case the Board feels a consultant is needed. The Chair noted that the RFP 'is nota guarantee that a consultant <br /> will be Hired_ <br /> The Planning Board took a to minute break and reconvened at 3:05 p.m. <br /> Regarding the 1/4/11 draft markup of the RFP, Air. Fudal stated than he and Mr. Storrs ironed out the little <br /> details and the biggest question was regarding whether or not fiscal impact will be part of the RFP. The Chair <br /> requested that it remain in case an impartial c nsultwd is needed. Attendees discussed wording on page 6 <br /> regarding use of fiscal'impact study versus fiscal impact report based on the information that would be gathered <br /> by the Cape Cod Commission. Mr. Ston-s reoinrn nded that on page 6, below Economic Development Fiscal <br /> Impact, wording be changed to read"The Board's consultant will comment on the fiscal impacts of the project" <br /> and Board members agreed. lir. Mullin recommended changing"the consultant shall' to"the consultant may <br /> throughout the entire RFP. At the bottom of page 4, Mr. Storrs recommended that the sentence read`In <br /> addition to the review of the fiscal impact analysis, the Town seeks assistance . . ." and noted, in the rest of the <br /> sentence, that he wouldn't expect another party to be involved with negotiations. lir. Fudala responded that the <br /> intent was that the consultant would be assisting the Board with carrying out negotiations. It was recommended <br /> that the wording be adjusted to reflect that the"consakant seeks assistance in developing and carrying out <br /> negotiations." The Chir felt that the consultant would not be in a position to negotiate and that if it got to that <br /> point, Town Counsel would be involved. <br /> 1 . Rowley questioned when the RFP would be sent and the Chair responded that it would depend upon <br /> whether I ashpee Commons submits their application by February. Mr. Rowley suggested that response may <br /> be limited if the consultants' expertise will be unnecessary for 6-8 month because consultants could be <br /> uninterested i <br />
