t t lahpee Planning Board Minutes of Meeting January 1 , 01.1 at-7 p.m. Selectmen's Meeting Room 1 fashpee Town lull CALL TO ORDER The Town of l lashpee Planning Board meeting was opened with a quonun in the Selectmen's Fleeting Room at Mashpee Town Hall by the Chairman t 7:00 p.m. on Wednesday, January 19, 2011. F Planning Board Members Present: Chairman Diary waygan, vice Chair Dennis Bal arini, George Petersen and David Kooharian Also Present: Tom Fudala-'Town Planner, Charles Rowley-Consultant Engineer Absent: Clerk Joe Mullin APPROVAL OF MINUTES January 5. 2011 Mr. Petersen's suggested changes were discussed, correcting Mashpee Fire Code BUi1d'Mg Code to Massachusetts State Fire Code Building Code on page 2 and at the bottom of page 6, changing Compass to Comm-PASS. MOTION: Mr. Kooharian made a motion to accept_the minutes from January 5th as amended. Mr. Kooharian seconded the motion. All voted unanimously. PUBLIC WEARING 7:10 Applicant: W ndchime Condominium Trust, c/o Marion Baler lAwation: Windchime Point Condominium, Great Neel Road South Request: Modification of specie! permit to qmcify a process for approval, on behalf of the Planning Board, of removals of dead, d' r otherwise hazardous trees. The appointed time having arrived, the Chair opened the Public Hearing and read for the record the Public Hearing Notice. Mafion Baker, Chairman of the Board for the Windchime Condominium Association introduced herself to the,Planning Board, 11►lr. Fudala reported that Board members have been in receipt of the application, a letter requesting a fee reduction and a list of 13 trees identified for removal. IVIS. Baker noted that the Board had agreed to reduce the fee from $500 to $230. Ms. Baker reported that certified arborist Rick Cox, vice President ofHo ie Landscaping, examined each of the trees identified for removal. Board members viewed an aerial photo of the entire location but lis. Baker indicated that the 13 trees are scattered among I 1 different locations, Mr. Pudala reported that the trees will be marked and recommended that the Board perform a site visit to View the existing conditions. In addition to approving the removal of the-trees, Il r. Pudal recommended setting up a process by which future trees can be removed without rewiring a public . hearing. The special permit does not presently include a process and Mr. Pudala suggested that either Mr. Rowley or a Planning ward Repnnattative could review the tomes and request along with an arborist, reporting back to the Board- The Chair questioned whether sample language is available from another permit but lir. Fudala responded that them are no other processes in place, although an effort to create one had been dit-UMP-ted at SouthpW. Mr_ Pudala noted that the detailed 1
