F <br /> Planning Board Members Present: Chairman Diary waygan, vice Chair Dennis Bal arini, <br /> George Petersen and David Kooharian <br /> Also Present: Tom Fudala-'Town Planner, Charles Rowley-Consultant Engineer <br /> Absent: Clerk Joe Mullin <br /> APPROVAL OF MINUTES January 5. 2011 <br /> Mr. Petersen's suggested changes were discussed, correcting Mashpee Fire Code BUi1d'Mg Code to <br /> Massachusetts State Fire Code Building Code on page 2 and at the bottom of page 6, changing <br /> Compass to Comm-PASS. <br /> MOTION: Mr. Kooharian made a motion to accept_the minutes from January 5th as <br /> amended. Mr. Kooharian seconded the motion. All voted unanimously. <br /> PUBLIC WEARING <br /> 7:10 Applicant: W ndchime Condominium Trust, c/o Marion Baler <br /> lAwation: Windchime Point Condominium, Great Neel Road South <br /> Request: Modification of specie! permit to qmcify a process for approval, on behalf of <br /> the Planning Board, of removals of dead, d' r otherwise hazardous trees. <br /> The appointed time having arrived, the Chair opened the Public Hearing and read for the record the <br /> Public Hearing Notice. Mafion Baker, Chairman of the Board for the Windchime Condominium <br /> Association introduced herself to the,Planning Board, 11►lr. Fudala reported that Board members <br /> have been in receipt of the application, a letter requesting a fee reduction and a list of 13 trees <br /> identified for removal. IVIS. Baker noted that the Board had agreed to reduce the fee from $500 to <br /> $230. <br /> Ms. Baker reported that certified arborist Rick Cox, vice President ofHo ie Landscaping, <br /> examined each of the trees identified for removal. Board members viewed an aerial photo of the <br /> entire location but lis. Baker indicated that the 13 trees are scattered among I 1 different locations, <br /> Mr. Pudala reported that the trees will be marked and recommended that the Board perform a site <br /> visit to View the existing conditions. In addition to approving the removal of the-trees, Il r. Pudal <br /> recommended setting up a process by which future trees can be removed without rewiring a public <br /> . hearing. The special permit does not presently include a process and Mr. Pudala suggested that <br /> either Mr. Rowley or a Planning ward Repnnattative could review the tomes and request along <br /> with an arborist, reporting back to the Board- The Chair questioned whether sample language is <br /> available from another permit but lir.
