Mr. Fudala also noted t.ht here are areas of open space at Winchirne that <br /> should not be touched and that the includes a condition staffing that nothing beyond 20 feet <br /> past the perimeter of the buildings may be touched and that the boundary and the buffer along Route <br /> 28 have been restricted as open space. Plans should be reviewed for further detail and confirmation <br /> regarding open space and buffer areas and trees could thea be marked on the plans. <br /> Board members discussed whether a tree can be removed if it is located in open space or the buffer <br /> and Mr. Fudala noted that the area is intended as a naftwal area and cannot be removed. Chairman <br /> waygan suggested that a tree identified as diseased by the amorist for removal may need to be <br /> removed. Mr. Fudala suggested that some trees could be treated_ Chairman waygan requested <br /> more information from.1r. Cox regarding the diseased trees and Ids..Baker suggested marking the <br /> trees-with two different colors in order to distinguish the diseased trees. <br /> Mr. Petersen questioned whether the hazardous trees presented a hazard to the public and Ms. Baker <br /> responded that they present a hazard to individual homes. W. Rowley noted that a hazardous tree <br /> with the potential to fall into a roadway would require removal, even in open space. Ibis. Baker <br /> reported that a tree had fallen on.a home four years ago. <br /> A site visit was scheduled for Same-day, January 29 at ip.m_ and will be posted as a meeting. W. <br /> Petersen has a conflict and may view the trees on another date. Board members will meet at the <br /> indchime Clubhouse. <br /> Eileen Prose(#10) and Art Trowseck(#11), longtime residents of Windchime, expressed concern <br /> about the cuing of the namW underbrush on the first circle in the development and alongside <br /> Creat beck Road. Mr. Tro rsmk suggested that a program.be established to ma e the cutting <br /> since the buffer used to provide some shielding from the h-Wffic and also recommended a program to <br /> protect and prevent diseased trees. Mr. Trowseck also recommended that the trees being removed <br /> be replaced with new trees. The Chair recommended than their requests be submitted to both the <br /> Condominium Association Board and to the Manning Board and invited the residents to attend the <br /> site visit on January 29. Mr. Fudala.read the oondition in the 1987 permit stating that no clearing or <br /> alteration of vegetation occur outward toward the property perimeter beyond 20 feet of foundation <br /> walls, 10 feet from a roadway or walkway and 5 feet from the site utilities without permission from <br /> the Planning board. 'The Chair indicated that it may be a nu'scommumcation. Mr. Fudala has <br /> scanned the necessary documents and modifications for the planning Board. <br /> MOTION: Mr. Bad arinl made a motion to continue the Public Hearing to February 2 at 7:10 <br /> p.m. Mr.Ko barian seconded the motion. All voted unaaimou l . <br /> APPROVAL.-NOT-REQUIRED PLAN <br /> Torn Bunker, BSS, was in attendance at the muting to represent 1lashpee Commons regarding <br /> their request to divide the Mashpee Commons property into two lots for finance purposes. Mr. <br /> Bunker referenced the two plans provided to Board members, noting that most of the I iashpee <br /> Commons land is Land Court land but that a snnall corner is not land court and is not registered <br /> land. Mr. Bunker pointed out the new lot line-which runs along the southern edge of the pavement, <br /> and noted that Lot 1.1 and Lot 12 are Land Court land and Lot 16A and Lot 16B are unregistered <br /> 2 <br />
