Mr. Creedon d that the prior <br /> owner had entered a Development Agreement in the Industrial Park that was signed in <br /> 1997 and recorded in 1993. The prior owner presented.an application to the Zoning Board with a <br /> plan similar to the one being presented at tonight's meeting. Zoning relief was required for the <br /> setback non-conformity and was approved in 2007. The request then went to joint Design and <br /> Plan Review,,, when it was discovered that the Development Agreement had spired in 2007. <br /> The prior owner then approached the Cape Cod Commission with an application for a . <br /> Jurisdictional Determination and a Hardship Ex- emption in February 2007 and, while the <br /> Jurisdictional Determination was dropped,the Hardship Exemption was granted in August Zoo . <br /> The prior onr meted the sale of the property permuted, with the approval of the Cape Cod <br /> Commission, and had not been reviewed by any town boards until May 2010. when the <br /> property was under-agreement, the awm owner and applicant, along with the prior owner, <br /> requested a variance from the Zoning Board which was granted in May 2010. The property was <br /> official I acquired in June 2010 and the appli cafion was filed and considered at the joint.Design <br /> and Plan,review rrrWing yesterday morning. f <br /> Mr. Creedon stated that they had been in receipt of Mr. Rowley"s report and noted that some <br /> updates and revisions will be shared with the Board as a result of yesterday's-meeting. The <br /> Chair stated that the Board needed a plan to review. Mr. Fudala stated that smaller versions of <br /> the plan had not been provided. <br /> Mr. Creedon stag that a 202000 square foot, multi-tenanted building was being proposed. fir. <br /> Creedon Mated that the application has been filed under Section 6 for wholesale business and <br /> storage. Mr. Creedon expressed hope that the facility would be tenanted soon ager the <br /> completion of construction. The Chair inquired whether the application had been reviewed by <br /> the Board of Appeals and Mr. Creedon responded that a variance had been granted by the ZBA <br /> and noted that the BOH approval for the:innovative alternative de-nitre cation system needed to <br /> e refiled since it had expired. Mr. Creedon noted that the Cape Cod Commission Hardship <br /> Exemption would be good for 7 years from 200 8. There was discussion about the previous two- <br /> way Development Agreement and Mr. Fudala explained that, after it expired, the applicant <br /> agreed to comply with the conditions set by the Development Agreement and the Cape Cod <br /> Commission granted the Hardship Exemption_ Mr. Fudala noted that the l lan 'ng Board had <br /> previously approved a special permit for a parking lot that was origin ail y associated with the <br /> adjacent property. <br /> Mr. Rowley stated that his mart matched the special permit requirements to the plans provided. <br /> Mr. Rowley noted missing information and non-compliance in his report. Chairman Wa rg n <br /> inquired about the changes referenced as a result of the Site Plan review meeting. Mr. Fud la <br /> reported that the lotion of the leeching area needed to be re-located or large-trees at the <br /> location would need to be removed. Secondly, the Fire Department had requested that the <br /> Commercial.Street entrance be relocated and a fire lane be added at the back of the building. <br /> Mr. Breedon responded that those changes had been agreed to and added that they planned to re- <br /> situate the curb cut irr order to achieve improved access. Mr. Rowley inquired about the <br /> landscape and site plan that indicated a concrete sidewalk around the entire building whereas the <br /> building plan shoved the-sidewalk on three sides, resWting in only a 12 foot strip between the <br /> corner of the sidewalk and the edge of the buffer shwL It was noted that the site plan would <br />
