Chair Baumgaertel asked if Mr. Karson or Ms. Forbes was aware if there were any preliminary results on <br /> the USGS study(with the fish)and Ms. Forbes answered that there were no results yet. Chair Baumgaertel <br /> stated that the base was doing a great job addressing the problem. He and Mallory Langler thanked both <br /> presenters for the update,and for the great work they are doing. <br /> 7:35—Title V Variance,20 Evergreen Circle <br /> Mr. Harrington advised the Board that the engineer for this project was not in attendance, and <br /> recommended a continuance. <br /> Mallory Jangler moved to continue the matter of the Title V Variance at 20 Evergreen Circle to the next <br /> Board of Health Meeting. Motion seconded by Brian Baumgaertel. VOTE: Unanimous(2-0), <br /> OLD BUSINESS <br /> 1. Request for Tobacco Sales Permit — 9 Shellback Way, Colbea Enterprises I.I.C. Mr. Harrington <br /> stated that no new information had been provided. He advised the Board that the applicant has <br /> until December 28,2018,when the new regulation takes effect,to provide evidence of ownership. <br /> Mallory Langler moved to continue the Request for Tobacco Sales Permit at 9 Shellback Way to <br /> the next Board of Health Meeting. Motion seconded by Brian Baumgaertel. VOTE: Unanimous <br /> (2-0). <br /> NEW BUSINESS <br /> 1. Approve Board of Health Meeting Minutes. The minutes of the October 25,2018 and November <br /> 8, 2018 Public Sessions were approved as presented. <br /> Mallory Langler moved to approve the minutes of the October 25, 2018 and November 8, 2018 <br /> Public Sessions. Motion seconded by Brian Baumgaertel. VOTE: Unanimous (2-0). <br /> 2. Sign Expense Warrants. Board members signed the expense warrant. <br /> 3. Request for Cesspool Variance—49 Highwood Way. Mr. Harrington stated that this property is <br /> being sold as is and with a cesspool; therefore, a variance is required from our Cesspool <br /> Regulation. The mitigation for the variance is an enforceable agreement that the buyer must sign <br /> to take responsibility for replacement of the septic system within a specified timeframe. The <br /> buyer or their representative has been asked to attend the meeting to help the Board determine <br /> the future use of the property, which will dictate the required timeframe for septic <br /> repair/replacement. <br /> Tim Nealon, attorney for the applicant, introduced himself and stated that his clients have a P&S <br /> on the property, with a closing of December 13th. They have engaged Capewide Enterprises to do <br /> soil tests and facilitate the design of the new system, but their concern is the time of <br /> year/weather. The applicants may visit the property periodically after taking ownership,but don't <br /> plan to stay for any extended period until the summer, after the new septic has been installed. <br /> Chair Baumgaertel asked if the applicants had any plans to rent the property,and Attorney Nealon <br /> indicated that he was not aware of any. Mr. Harrington stated that this was not an emergency, <br /> and the system was not overflowing or backing up. He further stated that there were no <br /> conservation issues, and that the Board has historically given 90 days from the transfer of the <br /> 2 <br />
