Ms, Langler asked Attorney Nealon if there was any <br /> foreseeable reason why they would not be able to meet that deadline,to which he answered no. <br /> Mallory Langler moved to approve the Cesspool Variance at 49 Highwood Way with the following <br /> conditions: 1).an executed enforceable agreement be submitted to the Health Department within <br /> 7 days; 2) engineered plans be submitted to the Health Department within 45 days; and 3) <br /> installation of the new system take place within 90 days. Motion seconded by Brian Baumgaertel. <br /> VOTE: Unanimous (2-0). Mallory Langer amended the Motion to state that the 45 and 90 day <br /> deadlines will commence upon transfer of property. Amended Motion seconded by Brian <br /> Baumgaertel. VOTE: Unanimous (2-0). <br /> ADDITIONAL TOPICS <br /> Chair Baumgaertel stated that the Board of Selectmen had requested a joint meeting to discuss future <br /> development at Mashpee Commons. He asked Mr. Harrington to let the Town Manager know that the <br /> Board is available for a joint meeting on Tuesday,January 15, 2019, <br /> Chair Baumgaertel inquired if Mr, Harrington had heard back from Brian Dudley on their questions relative <br /> to the Innovative/Alternative Septic Regulation. Mr. Harrington answered that DEP Boston did get back <br /> to him and, because manufacturer no longer has a permit, they were going to remove the system. He <br /> further informed the Board that the property owner was going to file directly with Boston so they could <br /> get an answer straight from DEP. <br /> NEXT MEETING <br /> The next meeting of the Board of Health was scheduled for December 6, 2018 at 7:00 PM. <br /> There being no further business, Mallory Langler moved to adjourn the Public Session Meeting of the <br /> Board of Health at 7:40 PM.
