MASHPEE ZONING BOARD of APPEALS <br /> DECISION FOR SPECIAL PERMIT <br /> Petitioner, Cape Cod Dog Center, Inc. <br /> (Owner of record: Evergreen Energy LLC) <br /> 588 Main Street 31 Evergreen Circle) <br /> Il ashpee, MA 02649 <br /> SP-2018-54 <br /> Attorney Kirrane said that the Board has the discretion if"the project is improved <br /> esthetically, and they agree, then the parking can be in the front of the building. The <br /> Attorney said his clients have a separate plan showing signage with "drop off and pick up <br /> only" in the front-of the building. Attorney KhTane said that either temporary drop off and <br /> pick up parking with designated spaces or if the Board prefers to have the second concept <br /> option that was shown. The second option could cause traffic, issues. <br /> Mr. Mendoza wanted confirmation that the number of parking spaces were <br /> exceeded, and the employee parking is in the rear of the building. He asked if the parking <br /> spaces in the front are specifically used for dropping and picking up of animals. He <br /> mentioned that a vote was taken and documented at Flan review to beep the original layout <br /> of the building because it is much more attractive, and showed the temporary parking <br /> spaces. <br /> Chairman Furbush asked where the parking is located at the Sandwich location,and <br /> how many cars are there at any length of time. <br /> Dailey said that there is parking ire the front of the building and her customers tend <br /> to be about 10 to 15 minutes to drop off and pick up there dogs. <br /> Chairman Furbush mentioned that he received a letter from the Conservation Agent <br /> regarding some disturbance at the end of the road. <br /> Attorney Kirrane had a conversation with the developer's attorney of this issue. <br /> There isn't any risk with the Board acting on the permit. Attorney Iirrane will not be <br /> closing on the property until these issues are resolved. <br /> The Board read the Conservation, Board of Health, and Inspection Department <br /> comments into the record. <br /> Chairman Furbush xead Charles owley's comments into the record. <br /> There were no abutters present. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday,November 28,2018,the Zoning Board of Appeals voted unanimously to issue <br /> a Special Permit with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 94 <br />
