MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 12, 2018 <br /> Attorney Bowen addressed the Board stating that the words "regulatory taking" is unfair <br /> and is not applicable. If the Board follows the procedures and issue a ruling based on the <br /> regulations and zoning bylaws that there's no paved road,there's no access,and there's no <br /> bridge, there's only a drawing. Their drawings and request for a bridge were denied. <br /> Attorney Connolly agreed with Attorney Bowen. <br /> Mr. Mendoza. asked Attorney Wall if his client was entertaining to build more than one <br /> home on the island. Mr. Wall said his client's intention right now is to have one'single- <br /> family dwelling. <br /> Attorney Wall said that he prepared a case in Falmouth regarding a "regulatory taking" <br /> when there was a denial of a variance with the Conservation Commission that is currently <br /> under appeal. <br /> There were no more comments from the Board or audience. <br /> Chairman Furbush closed the comment session and instructed the Board members that it <br /> was time to vote. <br /> Gooseberry Island and Punkhorn Point Road: Owner, Gooseberry Island Trust& SN <br /> Trust requests a Variance from §174-12 of the Zoning By-laws requiring frontage on a <br /> street and direct access to a paved town, county or state road or street as defined in said <br /> Section in order to construct a single family residence on property located in an R-3 Zoning <br /> District, (Map 100,Parcel 6-0-R), Mashpee, MA. <br /> Mr. Goldstein made a motion to approve the request for a variance. <br /> Mr. Gould seconded. <br /> Chairman Furbush polled the members to vote. <br /> Ms. Sangeleer, denied, no, <br /> Mr. Pittsley denied,no, <br /> Mr. Gould, denied, no, <br /> Mr. Goldstein, denied,no, and <br /> Mr. Furbush, denied, no. <br /> All unanimously denied the Variance request under §174-12. <br /> Gooseberry Island and Punkhorn Point Road: Owner, Gooseberry Island Trust & SN <br /> Trust requests a Variance from§174-31 of the Zoning By-laws requiring a 150' of frontage <br /> on a street in order to construct a single family residence on property located in an R-3 <br /> Zoning District, (Map 100, Parcel 6-0-R), Mashpee, MA. <br /> 7 <br />
