Mr, Johnson suggested the Committee support the project and allow,the project proponent to sort out <br /> financial issues. <br /> Mr. Johnson made a motion that the Committee approve the concept of developing the property <br /> at 4 otuit load for affordable rental housing,which is needed in the town, but withhold <br /> comment on the financing of the project until Mr. Pena's development team can clarify it. Mr. <br /> Willard seconded the motion. All voted unanimously. <br /> OLD BUSINESS <br /> 950 Falmouth Road Feasibility Study-Chairman Isbitz reported that the site orientation <br /> occurred on August 14. It was determined that the A and B portion of the site could possibly be <br /> developed,while C would remain undeveloped. The'Affordable Housing Trust met to approve the <br /> funds for the feasibility study: The Chair stated that all available fonds had been clarified and it was <br /> noted that the Cape Cod Commission mitigation funds, which the Affordable Housing Trust had <br /> approved for the phase II feasibility study, worked on a reimbursement basis. The ,affordable Housing <br /> Trust meeting was short with a brief presentation from Horsley Witten and approval of funds. The <br /> Chair pointed out that the contract with Horsley Witten had outlined a lick off meeting with a <br /> question/answer session, Chairman Isbitz spoke with Mr. Taylor about requesting an informal meeting <br /> between Horsley Witten and the Affordable Housing Committee to provide a question/answer session. <br /> Mr. Taylor will contact Horsley Witten about the possibility about attending the next Affordable <br /> Housing omen ttee meeting on October 10. The cost of the contract was $23,000 along with a 5 NO <br /> contingency. <br /> Chairman Isbitz stated that correspondence was received from the president of Holland Mills <br /> -Estates, Susann Patterson, regarding their concerns about the site. Inquiry was made regarding the <br /> road that would be used for access. Mr. Taylor met with Ms. Patterson to confirm that the road she <br /> was.concerned about would not be used as the main entry, but might be used as emergency hire <br /> Department access. Mr. Abbot confirmed that he had also received an email from her and had assured <br /> her that he would stay in touch with her, Mr. Abbott also shared the information with Brian Kuchar, <br /> the consultant at Horsley Witten, who also did not plan to use the road. <br /> Affordable Housing Trust, Status Report on Land Transfer-Chairman Isbitz recalled that <br /> the vote was taken at May Town Meeting approving transfer of two sites, 209 Old Barnstable Road <br /> and 950 Falmouth Road, to the Affordable Housing Trust. Since the Affordable Housing Trust was a <br /> separate legal entity, the next step was for Town Counsel to make the land transfer to the Trust. <br /> Chairman Isbitz reported that Mr. Taylor would follow up with Town Counsel to have the land <br /> transferred and filed with the Registry of Deeds. <br /> Main Street village; 37 Center Street, ZRA Decision-Chairman Isbitz reported that the ZBA <br /> did not approve the homeowners request to wive the deed restriction. The seller now planned to <br /> pursue the request in court. The Chair spoke'with Mr, Taylor to find out if Town Counsel would <br /> represent Mashpee at the hearing. It was noted that HA. had waived the buyer income restriction, <br /> since there were no eligible buyers, allowing the seller to sell to a buyer with a higher income. <br /> However, the income and sale price restrictions would rernain in the deed upon sale so that upon resale <br /> the new sale would then be constrained by the deed restrictions. H 's view was to lower;the price of <br /> the unit until a buyer carne forward, which was the intent of the program, i.e., to keep the unit <br /> affordable. It was noted that the seller purchased the property with the restriction, but was attempting <br /> to sell the property at market value. . <br /> 3 <br />
