0 <br /> z <br /> BYLAW REVIEW COMMITTEE MEETING <br /> THURS AY9 NOVEMBER 99 201' <br /> MA BPEE TOWN CLERKS OFFICE <br /> Present: Edward Larkin,Deborah Dami,Margaret Santos,Andrew McManus, and Paul <br /> Robillard. <br /> Also Present: Michael Mendoza–Building Commissioner <br /> Ed Larkin}Chairman, called the meeting to order at 4:31 p.m. <br /> Appr val of Minutes <br /> Motion; Paul Robillard motioned to approve the minutes of the October 26, 2017 Bylaw <br /> Review Meeting; and Deborah Rami seconded this motion. <br /> VOTE: 5-Yes, Unanimous. <br /> Margaret Santos–yes Edward Larkin.–yes Andrew McManus-yes <br /> Deborah Dami-yes Paul Robillard–yes <br /> Reviewlnl actin the Buildin Ike artrent <br /> By a of some background,Mike Mendoza explained that when he vas first hired as <br /> the Mashpee Building Commissioner the then-Town Manager asked him.to review the <br /> p . <br /> bylaws and so he's been doing that on an on-going basis. <br /> Mike said that inp rep ari ng for this meeting with the Bylaw Rev i env Committee,he and <br /> Drew McManus discussed and agreed that there are Zoning Bylaws that have become <br /> outdated and/or offer no value whatsoever as written. As ars example,Mike and Dreg <br /> commented on bylaw§174.251(9)of the Land Use Table wWch provides that the <br /> applicant trust get a special permit from the ZBA and must also be approved by <br /> Conservation. Drew said this costs the applicant fees to bring the same project before <br /> both Conservation and ZBA and,in addition.,fees for 2 buffer notification mailings— <br /> once for the Conservation hearing and then again for the.SBA hearing. <br /> Mike Mendoza said it is unnecessary and redundant to go to 2 boards for the same <br /> project, <br /> especially ' <br /> ect es lly since the BA relies on the ruling made by Conservation. Mike said <br /> � <br /> that's why he and Drew are suggesting this bylaw be changed to Indicate under thi�Land <br /> Use Table that Conservation has sole responsibility. Both Mile and Drew also agree that <br /> BA should have input on this proposed change, <br /> Mike and brew participated in a lengthy discussion on several Zoning items they were <br /> resentin to be considered by the Committee. Mike provided a -page list of items <br /> pg <br /> under 174. A copy of the list is attached to the printed set of these minutes. <br />
