4 <br /> For May 5, 1997 Annual Town Meeting <br /> ARTICLE <br /> To see if the Town will vote to amend the ZoningBy-law as follows: <br /> By arnending Article 11 Definitions, § 174-3, by inserting the following after <br /> ACCESSORY Y USE and before APARTMENT: <br /> ""ADULT USES: An adult bookstore, an adult motion picture theater, an adult <br /> paraphernalia store, an adult video store, an establishment which displays live nudity, as <br /> } further defined below, and such other uses as provided by Chapter 40A, Section 9A. <br /> } (1) ADULT BOOKSTORE: an establishment having as a substantial or significant <br /> portion of its stock in trade, defined as a minimum of25% of the total inventory a <br /> determined by the Building Inspector, boobs, magazines, and other natter which <br /> are distinguished or characterized by heir emphasis depicting, describing, or <br /> relating to sexual conduct or sexual excitement as defined by Massachusetts <br />. General Laws, Section 31 of Chapter 272. <br /> (2) ADULT MOTION PICTURE THEATER: an enclosed building used for <br /> presenting material distinguished by an emphasis on matter depicting, describing, <br /> or relating to sexual conduct or sexual excitement as defined by Massachusetts <br /> General Laws, Section 31 of Chapter 272. <br /> (3) ADULT PARAPHERNALIA STORE: an establishment having as a substantial or <br /> significant portion of its stock, defined as a minimum of 25% of the total inventory <br /> as determined by the Building Inspector, devices, objects,tools, or togs which are <br /> distinguished or characterized by their association with sexual activity, including <br /> sexual conduct or sexual excitement as defined by Massachusetts General Laws, <br /> } Section 31 of Chapter 272. <br /> (4) ADULT VIDEO STORE; an establishment having as a substantial or significant <br /> portion of its stock in trade, defined as a minimum of 25% of the total inventory <br /> as determined by the Building Inspector, videos, movies, or other film material <br /> which are distinguished or characterized by their emphasis depicting, describing, <br /> or relating to sexual conduct or sexual excitement as defined by Massachusetts <br /> General Daws, Section 31 of Chapter two hundred seventy-two. <br /> (5) ESTABLISHMENT WHICH DISPLAY LIVE NUDITY: an entertainment <br /> establishment which permits a person or persons to perform in a state of nudity as <br /> defined by Massachusetts General Laws, Section 31 of Chapter 272, or an <br /> establishment which displays lige entertainment which is distinguished or <br /> characterized by heir association with sexual activity, including sexual conduct or <br /> 1 <br />
