Proposed construction of <br /> footbridge and after-the-fact permit of landscape wall and sand deposition. Nol <br /> Resource Area: salt Marsh, Buffer Zone to Land Under ocean and Land <br /> Containing shellfish, LSCSF, Little River <br /> Torte Bunker, BSS Design} represented the applicant. He noted this is an after the fact <br /> filing to permit the landscape wall and sand fill on the uphill side of the wall and.a before <br /> the fact filing to permit the footbridge. <br /> The Agent reviewed the sequence of events. It was discovered the placement of sand <br /> over lam and an undetermined amount of the salt marsh. The gall wasn't there when <br /> the sand was dumped. The Agent required the installation of a gall to keep more sand <br /> from getting into the salt marsh until the time the applicant could core before the <br /> Commission to review this. whether or not to keep the gall is up to the commissioners. <br /> The Agent said it is still undetermined whether the sand is still in the salt marsh. He <br /> suggested having a wetlands expert go in and do soil pit tests and get a true line of <br /> where the wetland is an where that line is. The sand would have to be removed and if <br /> need be, the wetland would have to be restored. He noted a proposed walkway is part of <br /> the hearing. <br /> Mr. Bunker also gave the background. He said this is an after the fact application for the <br /> wall and the applicant would also life to have a footbridge installed to get across to the <br /> other piers rather than walking inland to the other piers. He also stated the Agent <br /> recommended the removal of the existing piles from the area as well as any rails <br /> remaining from the marine railway. It is also being proposed that an additional item of <br /> landscaping at the northeast corner of the property where '1,1 oo sq. feet of sandy lawn <br /> and underlying loans is proposed to be removed and replaced with clean sand as an <br /> extension of the existing sand/ornamental grass area. The Agent stated the footbridge <br /> is not a grater dependent structure and said this does not meet the performance <br /> standards because the piles will be going into the salt marsh and any alteration of the <br /> salt marsh violates the performance standards. The next step is to do test pits to look at <br /> the soil. The Agent recommended to deny the portion of the footbridge and also hire a <br /> wetland expert at the cost of the applicant to delineate where the salt marsh is and <br /> based on the outcome mitigation to restore any areas of damaged salt marsh to its <br /> previously existing condition and then authorizing the deposition of sand above that salt <br /> marsh line and the gall to be retained so it doesn't wash back into the salt marsh. He <br /> suggested requiring the wetland scientist to investigate the wetland line and adjust the <br /> wall accordingly, allow the sand to remain above that line with a wall of adequate size. <br /> He recommended the Commission deny this project as proposed and follow up with a <br /> new enforcement order to hire a wetland scientist to investigate the salt marsh and come <br /> back for another hearing. <br /> Mr. Bunker requested a continuance rather than a denial of the project to give the <br /> applicant a chance to remedy the situation. The Agent said in terms of expediting what the Commission <br /> ultimately wants to see is getting the delineation of the salt marsh going sooner than <br />
