York, Jr., Shellfish Constable Q4bl� , <br /> Date: June 4, 1997 <br /> Re: 06-04-97 draft of conditions for the Tribal Council's proposed <br /> 8 acre Shellfish Grant in Popponesset Bay <br /> �Y <br /> This is the 06-04-97 draft of conditions for the Tribal Council's <br /> proposed shellfish grant in Popponesset Bay with input from the <br /> Tribal Council, the Harbormaster, the Shellfish Commission and the <br /> Waterways Commission. <br /> In addition to the specifications of Massachusetts General Laws, <br /> R� Chapter 130, Sections 57 through 68, and the Mashpee Shellfish <br /> Aquaculture License (Grant) Regulations, this grant is issued with <br /> following conditions: <br /> k*" 1. Shellfish shall be cultivated in or on the bottom sediments. <br /> 2. Protective gear shall be limited to nets secured to the bottom with <br /> sand bags or sand tubes. <br /> 3. The surveyed boundaries shall be marked at the corners with <br /> inflatable yellow markers at least 18 inches in diameter fastened <br /> with 3/811 or larger chain to helical anchors driven into the bottom. <br /> �h The words "SHELLFISH GRANT No. 007" and "BOATING ALLOWED" <br /> shall be printed on the markers with black figures at least 2 inches <br /> in height. <br /> 4. The Board of Selectmen shall have the option of changing the <br /> boundaries to allow for a navigation channel to be dredged through <br /> any area of the site. The total amount of grant area shall remain <br /> approximately the same after the boundary changes. The grant <br /> holder shall be given at least 90 days notice of the boundary changes <br /> in order to remove shellfish. <br /> S. The initial license shall be for a period of 10 years. The license <br /> {< may be renewed for periods of up to 15 years. <br />
