=y Page 21 Board of Selectmen Minutes _ April 1, 1996 AdmLm:=atj,yr,He 'n g-Raw Bar,Ing Motion made by Selectman Costa to declare that there has been cause shown to initiate discipline against the license holder of Raw Bar, Incorporated for violating Massachusetts General Law, Chapter 135, Section 34 by permitting patrons to leave the premises with open containers of alcoholic beverages in their possession on October 28, 1995. Motion seconded by Selectman Mills. Unanimous. 5-0. Roll Call Vote: George, yes Peter, yes Nancy, yes Judy, yes Jim, yes Town Counsel,Attorney William Hewig advised the Board of Selectmen as the licensing authority of disciplinary measures. Attorney Hewig indicated that the Board of Selectmen have the power to modify, suspend, revoke or cancel the license application of the Raw Bar,Incorporated. It is the Board's discretion,based on the evidence heard in finding violation as alleged. Attorney Hewig made note of the memo the Board received from Town Counsel dated March 25, 1996 relative to guidelines set forth by the AB CC, and use of discretion. Motion made by Selectman Costa to suspend the All Alcoholic Restaurant License of the Raw Bar, Incorporated for a term of 30 days commencing; July 1, 1996. Motion seconded by Selectman Dinizio. T Unanimous. 5-0. Motion seconded by Selectman Dinizio. YOLL: 4-1. Motion carries. Selectman Caffyn in opposition. Mr.Whritenour will submit formal notification to the license holder regarding the suspension of the license on behalf of the Board. g g
