The Agent showed some pictures <br /> of the site and the trees that are tagged to be removed and the mitigation area. He <br /> noted an inspection will be required by the Board of Health. <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue, seconded by Mr. Shaw. Vote <br /> unanimous 6-0. <br /> PRE/POST-HEARING AGENDA: (cont.) <br /> Enforcement Orders— 166 Waterway: Salt marsh violation and mitigation <br /> plantings <br /> The Agent stated there was a violation on 166 Waterway on the salt marsh. The <br /> assistant harbormaster noticed the salt marsh was covered over with sand. They <br /> notified the owner and he removed all of the sand so he is now in compliance. There will <br /> be an enforcement order for another violation forthcoming. <br /> 29 Overlook Knoll Road: DEP Superseding on-site visit <br /> The Agent stated Commissioners Dale McKay and Brad Sweet attended this meeting. <br /> Mr. Sweet said the biggest issue was notification. Two of the abutters stated they were <br /> not notified properly because their notices had been returned as undeliverable. Another <br /> issue was a test dig for the septic was done and the lawyer consultant thought that was <br /> the location to the coastal bank which would compromise the coastal bank. He noted <br /> the revetment is failing and the neighbors are concerned it may compromise the bank. <br /> Mr. McKay said the abutters felt we should condition the repairs to the revetment and <br /> mentioned a prior project nearby had not gone well. They also expressed concern about <br /> the square footage of the house. The abutters waited too long to file their appeal which <br /> didn't seem to be impressive with DEP. DEP asked both parties to file the necessary <br /> documentation addressing the wells. Mr. McKay noted DEP said all these matters will <br /> be taken under consideration. <br /> Motion: Mr. Smith moved to adjourn, seconded by Mr. Sweet. Vote unanimous <br /> 6-0.
