t <br /> z+, <br /> 16 Great Neck Road of-t <br /> Mashpee, Massachusetts 02649 <br /> BOARD of HEALTH - PUBLIC SESSION <br /> Minutes of the Meeting of January 19, 2017 <br /> Board Members Present: Also Present: <br /> alliope Egloff, Chair Glen Harrington, Health Agent <br /> Lucy Burton, co-chair <br /> Brian Baurngaertel, Clerk <br /> Chair Kalliope Egloff called the meeting to order at 7:00 FSM. <br /> APPOINTMENTS <br /> 7:1FTI —Asbestos violation Hearing —300 Nathan Ellis Highway— Lakeside Estates, <br /> Date Connelly, attorney with Mashpee Town Counsel, introduced herself to the Board. <br /> Brian Wall, attorney representing Lakeside Estates, introduced himself to the Board, <br /> Glen Harrington stated that the Board decision letter dated December 21, 2016, was the last information <br /> provided to Lakeside Estates. Attorney Mall requested a hearing in order for information to be provided to the <br /> Board of Health. <br /> Attorney wall commented that he has recently been retained by Lakeside Estates for this matter, Lakeside <br /> Estates is a manufactured housing community, sometimes referred to as a mobile home park. The property <br /> has 93 separate sites. Lakeside Estates owns the land and provides access to water, sewer and electricity. <br /> Private parties buy and oven the homes. From time to time homes are removed from the property, and homes <br /> are brought into the property. The mobile homes have a life span of 20 to 25 gears. Attorney Wall remarked <br /> that manufactured homes are under the jurisdiction of Housing and Urban Development (HUB) and do not <br /> require demolition and building permits. The rnanuf�ctured homes are not subject to the building code. <br /> Attorney Wall stated that in ,dune of 2016, Lakeside Estates removed several of the housing ..,nits from the <br /> property and demolished them. The units that there demolished were constructed in the 1980's.-Asbestos was <br /> prohibited from being used in the manufacturing process in the 1970's, and there 'was no reason to believe <br /> there were issues with asbestos. In the Mashpee Town Deport of 2015, it describes that the Building <br /> Department worked closely with the Health Department to update the requirements of demolition permits. A <br /> demolition permit in the Torn of Mashpee requires a letter stating whether or not asbestos is present. In <br /> twenty five gears Lakeside Estates never obtained a demolition permit and was unaware of the updated <br /> requirements. <br /> Attorney Wall discussed each of the letters that were seat to Lakeside Estates from the Board of Health. <br /> Attorney Wall remarked that there was an inspection performed at the sites where the homes had been <br /> removed. Samples were taken, and all of the sites with the exception of one did not contain asbestos. The first <br /> letter was the removal of the housing units without demolition permits. A survey is required by a licensed <br /> asbestos inspector before the demolition is to occur. In the next letter an order letter was issued to Mr. Have <br /> . y <br /> requiring ars asbestos survey. Mr, Haney thea filed a request for a hearing to discuss the order issued by the <br /> Board. Mr. Haney was unable to attend the scheduled hearing and requested another continuance.
