was not present at the December 15, 2016, meeting, and the Board decided to move forward. Fines for <br /> violations were issued and stated in the letter dated December 21, 2016, to Lakeside Estates for failing to <br /> perform asbestos surveys. Attorney Wall remarked that Lakeside Estates was not given an opportunity to <br /> comply. The Board fined Lakeside Estates, which was premature and not appropriate. Attorney Wall is <br /> requesting to rescind the fines. <br /> Kate Connelly commented that Attorney Wall's client did not attend the December 15, 2016, meeting that his <br /> client had requested. In Ms. Connelly's opinion Lakeside Estates waived the opportunity to present their case. <br /> Glen Harrington remarked that he spoke with the building commissioner regarding the definition of <br /> manufactured homes. Manufactured homes are considered a structure. A permit is required for the demolition <br /> of a structure} and an asbestos survey is required prior to the demolition. This is a state regulation that the two <br /> _departments are enforcing. Asbestos banning in the 1980's was only the troweled on and sprayed on. <br /> Asbestos was still allowed to be used in building materials. <br /> alliope Egloff stated that she is concerned about the emotional implication that the Board of Health made a <br /> decision on December 15, 2016, because the Board was annoyed. Lakeside_Estates has been a consistent <br /> agenda item. Ms. Egloff did not feel it was frustration on the part of the Board but more life going forward. <br /> Brian Baumgaertel commented that in Matthew Haney's letter to the Board of Health he did not use the word <br /> tappeal". it was not understood that he was appealing the enforcement orders issued on the prior date. At that <br /> point the date had passed, and there was no particular reason not to proceed in issuing the fines. The <br /> violations already occurred, and Mr. Haney failed to obey the Board of Health order. - <br /> lalliope Egloff remarked that additional information such as receipts, notices, and invoices were requested <br /> from fir. Haney as well as the request for the surveys. Nothing has been received as yet, and there is no <br /> reason that the information could not be provided. <br /> Lucy Burton commented that the required information was requested by the Board and ignored. A sufficient <br /> amount of time has lapsed. For three years Lakeside Estates has not provided a list of occupants: which is a <br /> monthly requirement, to the Board of Health. They.are consistently in arrears on their use tax to the Board of <br /> Health. The taxes are never paid on time, and the monthly fees are paid once or trice a year. These historical <br /> problems are the sort of things that upset the Board and compound the issues with Lakeside Estates. <br /> Mr. Harrington stated that his asbestos survey was limited in nature, and the Board needed to determine if any <br /> other asbestos was present. Asbestos debris is a hazard, and must be treated accordingly. <br /> The Board discussed the asbestos fines that were unposed upon Lakeside Estates at the December 15, 20163 <br /> Board of Health meeting. The Board will defer action until February 2, 2017, pending receipt of information on <br /> the name of the waste hauler and disposal; a Freight slip, invoice or bill of lading; the list of occupants, and the <br /> telephone number of the park property manager at Lakeside Estates prior to the meeting, <br /> Brian Baumgaertel made a motion that the Board of Health continue discussion on Lakeside Estates until the <br /> next scheduled Board of Health meeting on February 2, 2017. Lucy Burton seconded the motion. The motion <br /> was unanimously approved. <br /> Brian Baumgaertel amended the motion that the Board of Health require the information be provided by <br /> January 27, 2017. Lucy Burton seconded the motion. The motion was unanimously approved. <br /> NEW BUSINESS <br /> 1. sign Expense Warrants. The Board members signed the expense warrants. <br /> 2.
