Also Present: - <br /> Kalliope Egloff, Chair Glen Harrington, Health Agent <br /> Brian Baum aertel, Clerk <br /> Chair Kalliope Egloff-called the meeting to order in the Ockway Conference Room and adjourned the <br /> meeting to the Administration conference Room on the second floor of Mashpee Town Hall. <br /> Chair Kalliope Egloff called the February 16, 2017, Board of Health meeting to order at 7:00 PM in the <br /> Administration conference Room. <br /> APPOINTMENTS <br /> 7:15 P — Septic violations 300 Nathan Ellis Highway, Emit ##74— Lakeside Estates. <br /> Glen Harrington stated that the septic that services #72, 74, 76 & 78 Lakeside Estates were observed in failure <br /> on July 13, 2016. The Board of Health sent an order letter that a designer be hired within 7 days, pump the <br /> system within 24 hours to abate a nuisance, and install the new system within 30 days of receipt of the order <br /> letter. <br /> The letter of January 17, 2017, outlines the violations and the fines issued for non-compliance. It is this letter <br /> that prompted the request for the hearing. Two fines were issued: One for failure to hire a designer within the <br /> required timeframe and the other for failing to pump the system, as ordered. The thin violation was not issued <br /> a fine due to the Department of Environmental Protection involvement and was not considered the park <br /> operator's fault or control. <br /> Attorney Brian Wall, representing MEZ Realtor Lakesides Estates} introduced himself to the Board. <br /> Attorney Wall commented that the system was pumped on July 13, 2016. The order letter was received by <br /> MEZ Realty on July 25, 2016, and the next day Mr. Haney contacted Thomas Bunker at BSS Design and <br /> explained the situation. There were active communications between BBB Design and the Department of <br /> Environmental Protection in August. The system was pumped multiple times as needed, the Department of <br /> Environmental Protection approved the repair October 5, 2016, the system was pumped, and a new leaching <br /> field was installed October 16, 2016. Attorney Wall remarked that MEZI Realtor did act promptly on this matter. <br /> Mr. Harrington commented that the pumping was being addressed, but it would have been better if the <br /> pumping information was forwarded to the Board of Health. It was definitely a Department of Environmental <br /> Protection matter as far as the design, approval, installation, and certification. lair. Harrington did not receive. <br /> any information as to when the proposal was issued. <br /> Kalliope Egloff stated that if the Board of Health received the information from MEZ Realtor within a timely <br /> manner this past summer all of this could have been avoided. Ms. Egloff felt it was disrespectful to the Board of <br /> Health and the Health Department by not supplying the information upon request, <br />
