t <br /> Brian Ba u mg aertel made a motion that the Board of Health rescind the fines that were issued January 5, 2017, <br /> in relation to#74 Lakes1de Estates. I alliope Egloff seconded the notion. The notion was unanimously <br /> approved-. <br /> 7:20 PM —sanitary code violations —300 Nathan Ellis Highway, Unit##8 -- Lakeside Estates. <br /> Glen Harrington stated that on October 14} 20160 a complaint was rade to the Board of Health regarding low <br /> water pressure at##8 Lakeside Estates. An inspection was performed where the grater pressure was tested and <br /> during use, the grater pressure was found to be below the 20 psi or the minimum for the Sanitary code. An <br /> order letter was sent on October 17, 2016, to notify the park operator. No response was ever made to the <br /> Board of Health. on December 7, 2016, a follow-up inspection was performed to check the grater pressure. <br /> Again, during use the grater pressure was found to be less-than the 20 psi and in violation. Fines were issued <br /> for 41 days of non-compliance, The request for the hearing was received on January 5, 2017. The hearing was <br /> set for February 2, 2017, but where two other hearings were scheduled for February 16, 2017, a request was <br /> made by the park owner's counsel to continue until February 16, 2017, The Board obliged and continued.the <br /> hearing that was to confer on February 2, 2017. <br /> Attorney Brian Mall, representing MEZ Fealty, Lakeside Estates} introduced himself to the Board and thanked <br /> the Board for the continuance. Attorney Wall also apologized to the Board for his client's lacy of response, <br /> Mr, Harrington remarked that the Sanitary code states the water pressure must be sufficient. Mr. Harrington <br /> investigated the dumbing code and the Water District's Regulation and used, as a basis, that the 20 psi is the <br /> minimum for sufficient water pressure. Within the Sanitary Code the grater pressure is checked during the use. <br /> There is no specification to check during use within the local regulation. Water pressure is checked from the <br /> outside spicket since it is connected directly to the distribution system at Lakeside Estates. The pressure is <br /> checked while the system is running inside the unit, Also, this particular unit has a filtration system, <br /> lalliope Egloff inquired whether the filtration system is maintained and if-there is any evidence of leaking pipes. <br /> Ms. Egloff suggested that the owner ascertain a plumber and prove there are no issues within the inside of the <br /> unit. Brian Baunngaertel commented that if there were consistent leaks within the unit affecting the pressure <br /> that no pressure could be held. If there is a leak inside the unit, the owner is responsible for the repair. The <br /> Board and Mr. Harrington discussed whether the park owners should be required to hire a licensed plumber to <br /> do a full inspection of the unit's plumbing. <br /> Attorney Wall remarked that there is a fine of$4,1 go for the Sanitary Code Violation. Attorney Wall would like <br /> to suspend a decision on this matter with some sort of agreement on behalf of his client. <br /> Kate Connolly, attorney with Mashpee Torn counsel, introduced herself to the Board. <br /> Attorney Connolly suggested that it is too early to rescind the fines. Perhaps the owners are taking this <br /> situation seriously since they have hired an attorney. The Board should not rescind the fines until this issue is <br /> resolved. The parr owners should provide a copy of the leases proving that they have no responsibility for the <br /> inside of the unit and also prove they are not responsible for the plumbing, septic, and other issues. <br /> Brian,Baumgaertel made a motion that the Board of Health require ownership information in the form of a legal <br /> document of record for ago Nathan Ellis Highway, Unit#8, Lakeside Estates} for the Sanitary Code Violation <br /> prior to the next Board of Health meeting scheduled of March 2, 2017. l alliope Egloff seconded the motion. <br /> The motion was unanimously approved. <br /> 7:25 PM — Request for Tight Tank-- 20 Red Brook Road. <br /> l alliope Egloff made a motion that the Board of Health move the 7.25 Fill) Request for a Tight Tank discussion <br /> at 20 Red Broom Road to the next Board of Health meeting scheduled on March 2, 2017.
