Any major engine work will <br /> rewire moving the boat to a marina or boat yard. <br /> Fick McCracken and Pearson McCracken, owners of 73 Mercantile Way, introduced themselves to the Board. <br /> Fick McCracken commented that this is to establish the project as a condominium. The units will be sold as <br /> condominium units. The other space will also be a condominium as the family will own that area and lease it to <br /> tenants. This will be a gated, secure facility. The area is not intended to be overflowing with boats. A daily <br /> inspection of the property will take place} but there will not be full-time on--site personnel. <br /> Mr. Harrington stated that preventions must be in place in order to avoid spills. <br /> Brian Bay,.mgaertel suggested having signage prior to perforating any boat repair or maintenance work with <br /> instructions to notify the appropriate people for any mishaps. <br /> Mr. Harrington suggested that a rinse pad be used for removing the salt off the boats and trailers, and no <br /> detergents are to be used. There is a potential that industrial discharge can get into the environment. Boats <br /> can be washed within the building that has floor drains, since not all boat ramps have rinse stations. This is <br /> strictly a storage facility. <br /> Laurel Almquist made a motion that the Board of Health approve the site and Septic Design Plans for the boat <br /> storage business at 73 Mercantile Way with the conditions that detergents are not to be used for washing <br /> boats and signage for maintenance. Approve the Site and septic Design Plan that has one septic variance with <br /> the condition that all Board of Health commercial Requirements with the exception of#5 are approved. Mallory <br /> Langler seconded the motion. <br /> .Mallory Langler made a motion that the Board of Health aniend the previous motion to include the proposed <br /> language provided by the applicant that discusses the restriction of boat repairs and maintenance to the <br /> designated areas and the additional signage be posted listing the proper response to any spills that tale place. <br /> Brian Baumgaertel seconded the...motion. <br /> The motion of the amendment was unanimously approved. <br /> The main motion was unanimously approved, <br /> 9. Nitrogen Aggregation Loading Flan: Ockway Highlands. <br /> Glen Harrington stated that at the last meeting the Board requested Town Counsel to determine if third-party <br /> review and applicant payment thereof could be required. Town Counsel confirmed that the Board could not <br /> rewire third-party review and payment if it was not part of a regulation or by-law. Therefore, the only review <br /> fee is $250.00, but that has been used for single family lots. <br /> This submittal for ockway Highlands subdivision to the Board of Health is a colored version of the definitive <br /> plan:, the deeds when the owners purchased the facility land, a "Grant of Title 5 Nitrogen Loading Restriction <br /> and Easement on Facility and Credit Land'# a calculation sheet outlining the facility land area, credit land area <br /> and combined area referenced as Exhibit A. A copy of an approved Grant of Title Restriction and Easement <br /> from the Dennis Board of Health was provided for comparison. <br /> Mr. Harrington would like to make the Board aware of 310 CMR 15.216.5.c-which states that the Board can <br /> set any other conditions that the Approving Authority deems appropriate." Mr. Harrington mentioned this in <br /> regards to the fee. if the fee is set as a condition of approval and is deemed appropriate by the Board, then the <br /> applicant can accept it or appeal the decision.
