44, <br /> Town of Mas e <br /> pe <br /> -eat NeckRoad North <br /> Mashpee, Massachusetts 02 649 <br /> BOARD of HEALTH - PUBLIC SESSION <br /> Minutes of the Meeting of August 3, 2017 <br /> Beard Members Present: Also Present: <br /> Brian Baumpertel, chair Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Mallory Langler, Clerk <br /> Chair Brian Baumpertel called the meeting to order at 7:00 Phi. <br /> APPOINTMENTS <br /> 7:15 FSM — Failure to comply with Board of Health order—4 Tri-Town circle. <br /> Glen Harrington stated that a septic inspection occurred on February 22, 2017, where the two septic systems <br /> on the property at 4 Tri-Town circle were deemed in failure due to a high groundwater table and also hydraulic <br /> failure. on March 13, 2017f a letter was seat to the owner to hire an engineer or sanitarian to design a new <br /> system and have it installed within 45 days of approval. The owner received the letter on or about Larch 15, <br /> 2017. The designer was required to be hired by April 1, 2017. About that time, the owner requested more time <br /> to comply. No exact time frame was given as an extension, but a couple of additional weeks would have been <br /> reasonable. Since thea, no contact has been made with the Board of Health. If the middle of April is used, <br /> then 94 days of non-compliance have lapsed. <br /> Typically, the requirement for fixing a failed septic system per Title v is 2 years. However, a shorter timeframe <br /> may be set by the Board of Health. Clue to the existing Boil Absorption System being in hydraulic failure with an <br /> occupied dwelling, the distance to groundwater, and exceeding the number of dwelling units in the dwelling, a <br /> shorter timeframe was ordered. Since the signed certified green card was returned, the owner was expected to <br /> attend this meeting and provide any information for compliance of the septic system. <br /> Mr. Harrington commented that in past situations fines for a failed septic system are $100 a day. The other <br /> option is that the Board can set a date to condemn the home. if a date is set to condemn the home, the Board <br /> is to issue a written finding that the dwelling is unfit for human habitation. Because the dwelling is occupied} the <br /> occupants must receive a -day notice to vacate. <br /> The Board and Mr. Harrington discussed options pertaining to the failed septic system at 4 Tri-Town Circle, <br /> Mallory Langler made a motion that the Board of Health issue fines for 4 Tri-Town circle at $100 per day <br /> totaling up to the 94 days starting from April 15, 2017, and $100 per day going forward until Mr. Halpern shows <br /> good faith measures that he will become in compliance: In addition; he should also provide floor plans of the <br /> dwelling to determine the number- of bedrooms because the dwelling is meant to be single family, not multi- <br /> family. Lastly, mold a condemnation hearing on August 24, 2017, should the homeowner not have any action to <br /> rectify the situation. Laurel Almquist seconded the motion. The motion was unanimously approved. <br /> 7:20 PIVI Nitrogen Aggregation Loading Plan —232 Gotuit Road. <br /> Glen Harrington remarked that a continuance was requested for 232 Cotuit Toad. <br />
