l <br /> Mallory Langler made a motion that the Board of Health continue discussion for the Nitrogen Aggregation <br /> Loading Plan request for 232 cotuit load. Laurel Almquist seconded the motion. The motion was unanimously <br /> approved. <br /> 7:25 ply —Title V variance — 132 Great Fines Drive. <br /> Glen Harrington commented that a request for a variance from Title V has been submitted to allow a proposed <br /> in-ground swimming pool to be constructed 16 feet away from an existing leach pit in lieu of the required 20 <br /> feet at 132 Great Fires Drive. A 6 rail plastic liner is proposed to mitigate the variance. This is a new <br /> construction variance as the peel does not exist now. There are two requirements for the Board to grant a <br /> variance: manifest injustice and equal environmental protection. The liner meets the equal environmental <br /> protection standard so that half of the variance requirement is met. However, the owner or applicant must <br /> explain to the Board a hardship if the pool were to be shorter, <br /> Rick Benoit of south Shore Gunite Boots, representing 132 Great Dines Drive, introduced himself to the Board. <br /> Mr. Benoit commented that the request for the variance is a safety concern because the pool is already short. <br /> The slope of the floor of the swimming pool would drop quickly if the pool were shortened further. The slope of <br /> the floor must be conformed to since it is a state code and also becomes an insurance concern. <br /> The Board discussed the option of roving the pool closer to the property line and away from the leaching pit. <br /> Mallory Langler made a motion that the Board of Health deny the request for the variance for the swimming <br /> pool at 132 Great Pines Drive based upon lacy of manifest injustice provided by not enough of a setback to the <br /> leaching pit. It is more of a hazard closer to the leaching pit rather than a property line. Laurel Almquist <br /> seconded the motion. The denial was unanimously approved. <br /> NEW BUSINESS <br /> 1. sign Expense Warrants. The Board members signed the expense warrant. <br /> 2. review/Approve BOH Public session Minutes: July 20, 2017. <br /> Laurel Aimquist made a motion that the Board of Health approve the Public Session minutes of July 20, 2017. <br /> Mallory Langler seconded the notion. The motion was unanimously approved. <br /> 3. Request for 2017 Bodywork Practitioner License: Palma Puzzuofil. <br /> Glen Harrington commented that Palma Puzzuoli submitted all of the required certificates. She has 48 hours of <br /> craniosacral therapy, which is a sub-discipline of massage and also her State Massage License. Her <br /> application meets the Board of Health regulation. No license fee will be charged as she is working at Lyme <br /> Awareness of cape cod} a non-profit bodywork facility. <br /> Mallory Langler made a motion that the Board of Health approve Palma Puzzuoli's 2017 Bodywork Practitioner <br /> License. Laurel Almquist seconded the motion. The motion was unanimously approved. <br /> 4. levier of Manufactured Home Regulation Amendment. <br /> Glen Harrington remarked that at the Board of Health meeting of duly 6, 2017, comments were made <br /> concerning the email addresses to be added in the regulation if they were available, rather than making it a <br /> requirement. Mr. Harrington revised the regulation accordingly. The Board's final review and vote to adopt the <br /> regulation.are required. Mr. Harrington will then recommend to approve with review by the Water District, the _ <br /> Building Department, and Town counsel. The regulation will be advertised in the paper} adopted, and effective <br /> at that point. <br /> Mallory Langler made a motion that the Board of Health approve the Manufactured Housing Community/Mobile <br /> Horne Park Community regulations once it is reviewed by the Water Department, the Building Department, <br /> and Town counsel.
