5. Nitrogen Aggregation Loading Plan: oc way Highlands. <br /> Matthew Haney, manager of BcDM, LLC, introduced himself to the Board. <br /> Mr. Haney remarked that at the last meeting the Board requested the nitrogen plan showing the credit land. <br /> Also, the Grant of Title 5 Nitrogen Loading Restriction and Easement on Facility and credit Land has been <br /> modified to reference the new survey. <br /> Glen Harrington commented that a new Nitrogen Aggregation Plan has been prepared and submitted by BSS <br /> Design. To date, the deeds for the property, the definitive plan, the locus plan, the draft copy of the Grant of <br /> Title v Nitrogen Loading Restriction and Easement, and the subdivision drainage plans have been provided. At <br /> the last meeting, the applicant requested that Town counsel review the Grant deed document, and the chair <br /> agreed to that request, Mir. Harrington met with Town Counsel to review the Nitrogen Aggregation Plan <br /> application, and all was deemed in order with the exception of the Board comments that may be discussed at <br /> this meeting. <br /> Mr. Harrington had comments for the nitrogen aggregation plan: <br /> • A note needs to be added to state that no nitrogen sources are present on the credit land. <br /> • A note stating that the drainage for the subdivision is located on open space areas labeled c and D. <br /> Mr. Harrington had additional conditions, which are conditions of approval: <br /> The conditions of approval are taken from previous Department of Environmental Protection approvals <br /> for Nitrogen Aggregation Pian for subdivisions. Since the Department of Environmental Protection no <br /> longer reviews Nitrogen Aggregation plans, Mir. Harrington used their conditions to be adopted by the <br /> Board of Health. The requirements are the same as listed in the nitrogen loading guidance document <br /> and within Title V. The Board will also need to determine a fee, and the fee should be part of the <br /> Board's decision, as long as it is deemed appropriate. <br /> Laurel Almquist made a motion that the Board of Health approve the Nitrogen Aggregation Plan with the <br /> following required conditions: <br /> 1. Add the above two comments to the plan and require submittal of a revised plan. <br /> . The dwelling located on the lots covered under the Nitrogen Aggregation Plan is limited to the number <br /> of bedrooms noted in the Grant of Title v restriction and Easement and the approved Nitrogen <br /> Aggregation Plan. <br /> . The Grant of Title V Restriction and Easement shall specifically reference the approved plan with the <br /> most recent revision date and shall incorporate the plan as an exhibit to the document. <br /> 4. The credit land is restricted from further nitrogen loading in accordance with the approved Grant of Title <br /> V restriction and Easement. <br /> . consistent with the terms of the Nitrogen Loading Restriction and Easement, the applicant must file a <br /> certified registry copy of the Facility Land and credit Land Nitrogen Loading Restriction and Easement <br /> with the Board of Health within thirty (30) days of recording. <br /> . As each lot is sold, an appropriate Grant of Title v Nitrogen Loading Restriction and Easement for the <br /> Credit Land and the Facility Land shall be executed for each individual lot. <br /> 7. No Disposal system construction Permits shall be issued for the lots covered under the Grant until the <br /> Grant documents and the approved Nitrogen Aggregation Plan have been signed and recorded at the <br /> Registry of Creeds. <br /> 8. -The fee of $1,280.00 is paid prior to the issuance of any Disposal Works construction Permits. <br /> Mallory Langler seconded the motion.
