8. Discussion of Draft Recreational Marijuana Regulation. Mr. Harrington commented that he still <br /> has more questions than answers relative to recreational marijuana. State regulations require <br /> that applications be made first through the state, prior to applying for a local host agreement. <br /> Mr. Harrington considered the Town of Bourne's regulation which limits the number of <br /> recreational marijuana permits to 10. He informed the board that, according to our newly <br /> adopted zoning by-law, Mashpee is only able to issue one retail sales permit, which Is based on <br /> the number of liquor licenses issued in the town. However, he reminded the board that that <br /> particular zoning by-law has not yet been approved by the Attorney General. Mr. Harrington <br /> informed board members that he is hesitant to set-up a local license structure for the different <br /> types of uses -- transportation, grower, retail, etc. — because it will not supersede state <br /> regulations, The board could adopt 935 CMR 500 as a Board of Health regulation and it would <br /> .give us authority to Inspect that required lab testing Is being done and all licensing has been <br /> acquired. However,any outcome of our inspection,to Include revocation of a local license,would <br /> not affect the state license. It would prevent operation In Mashpee only, similar to our Septic <br /> Installer Licenses. Mr. Harrington stated that there is no definition in state regulations about <br /> marijuana infused products, such as oils,tinctures and extracts. These are.the main concern to <br /> Boards of Health and the Department of Public Health, due to them being concentrated. Board <br /> members asked Mr. Harrington to forward a copy of the Town of Bourne's regulation, as well as <br /> the MAHB checklist for marijuana. <br /> OTHER BUSINESS <br /> Chair Baumgaertel read aloud the email from the Office of the Town Manager/Selectmen relative to the <br /> upcoming joint meetings,to be held on January 14&15, 2019 at 6.30 p.m. The purpose of the meetings <br /> is ,to discuss wastewater management. Mr. Harrington noted to the board that Title V Regulation <br /> specifically requires there be some physical commitment by the town to put sewer in before the board <br /> can Issue any extensions on repairs. Also,the town will need to look at growth control once the sewers <br /> are in. Mr. Harrington will forward the link to the town's Comprehensive Wastewater Management Plan <br /> prior to the joint meeting. <br /> NEXT MEETING <br /> The next meeting of the Board of Health was scheduled for Thursday,January 3,2018,at 7;00 PM. <br /> There being no further business, Mallory Langler moved to adjourn the Public Session Meeting of the <br /> Board of Health at 8,30 PM: Motion seconded by Laurel Almquist, VOTE; Unanimous (3-0). <br /> Respectfully Submitted, <br /> Christine A.
