He stated this project <br /> consists of construction of a private recreational timber pier and will be consistent with <br /> other nearby piers and allow the applicant to access to Ockway Bay, The structure will be <br /> constructed using standard timber materials, the access stairs and elevated walkway <br /> sections landward of the salt marsh will be supported by 6 x 6 posts. He said he met early <br /> on with the Agent because of his concern with the water depth and the Agent told him <br /> there was no concern regarding viable shellfish habitat. He said they did their best <br /> balancing the length of the dock to the water depth. The entire walkway will be pile <br /> supported and referred to the profile. There are no floats and the pilings will be driven not <br /> jetted and work with the tide. The decking would be in accordance with Conservation <br /> Commission's requirements regarding spacing. The walkway would be elevated above the <br /> salt marsh. A minimum separation from mean high water of 5 feet for public access. He <br /> noted the bottom of the stringers would be elevated 6 feet above the salt marsh in <br /> accordance with the new regulations from the Division of Marine Fisheries. The Agent <br /> noted there appears to have had some pruning done on the top of the coastal bank area. <br /> The Agent reviewed the photos of the property, showing the existing pathway leading <br /> down to the salt marsh and extending out. He said there is no float proposed at this time. <br /> Mr. Bortelli said there would never be a float and would be welcome to that condition. <br /> There is no need for a float because it would be bottomed out at low tide and he advised <br /> his client against a float. The Agent stated Ashley Fisher is the Shellfish Constable and <br /> she did the calculation formula and she thought it would be best to do the mitigation <br /> calculation for a yearly payment to the town shellfish propagation program because there <br /> is no room for mitigation plantings. The cutting that was mentioned earlier was some <br /> damaged trees within the 50-foot buffer of the coastal bank were cut. He said he thought it <br /> was a miscommunication but thinks mitigation is in order which would be to reduce the <br /> existing pathway to the dock to 4 feet in width The harbormaster commented on the <br /> neighboring docks but as the docks are today it meets the setback requirement so there <br /> are no issues with navigation. The Agent noted a white pine sapling and he.didn't see any <br /> flagging and he would like to make sure what is being taken out for the access stairway <br /> because it is a very steep banking. There is an expectation that Thru- Flow decking will be <br /> used on the portion of the fixed pier that spans the salt marsh <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue as per the plan with the condition the <br /> stairway platform be clearly flagged over the bank so we can assess the vegetation, <br /> seconded by Mr. Dalton.
