Page 5 <br /> Board of Selectmen <br /> Minutes <br /> August 12, 1996 <br /> AEQMMEN75...AND BEARING& <br /> C-ont nental Cablevision re; Transfer of Control; <br /> .,r . .. .., <br /> Mark Riley,Counsel and Director of Government&Public Affairs for <br /> - y <br /> =r Continental Cablevision was present to discuss the proposed transfer <br /> with the Board of Selectmen. Mary O'Keefe was also resent for <br /> P <br /> discussion. <br /> Communication was received from Andrew Eliason, Ch ' a of the <br /> Cable Advisory Committee dated August 8, 1996 recommending the <br /> Board approve the transfer of control. <br /> Mr.Riley indicated that a regional hearing was held in Barnstable on <br /> July 1, 1396 to discuss the proposed transfer of control from Continental <br /> Cablevision to US West, Inc. <br /> The Special Magistrate for the regional hearings has issued his report <br /> which has concluded that US West has satisfied the criteria under the law <br /> and has the legal ability,technical expertise,management experience, and <br /> financial capability to operate the cable systems. <br /> The Board of Selectmen must approve the transfer or den the transfer <br /> i. Y <br /> based upon the above four criteria indicated Mr. Riley who noted that the <br /> deadline for action is Thursday,August 29, 1996. <br /> F <br /> It was noted that if the Board elects the option of no action the transfer <br /> is deemed approved. At this time, the Town of Wellfleet has approved the <br /> transfer as proposed. The Towns of Brewster and Eastham are scheduled <br /> to review the proposal. The Town of Barnstable using TCI Cable has <br /> agreed to transfer to Continental, but has not yet approved of the transfer <br /> to US west. <br /> Mr.Whritenour indicated that at this time, Continental Cablevision has <br /> a delinquent tax issue pending with the Treasurer/Tax Collector. Mr. Riley <br /> indicated that he will further review this matter. <br /> Motion made by Selectman Costa to continue the matter <br /> relative to the proposed transfer of control from Continental <br /> Cablevision to US West, Inc. until <br /> Monday, August 26' <br /> 1996.M <br /> Motion seconded by Selectman Caffyn. <br /> Y.Q.T.E: Unanimous. 5-0. <br /> f.- <br /> {ym: x <br />
