Abutter notification is not required for projects proposed by the <br /> Massachusetts Department of Transportation Highway Division, pursuant to Chapter 472 of the <br /> Acts of 1993 as approved on January 13, 1994. The applicant shall provide notification at the <br /> mailing addresses shown on the most recent applicable tax list available in the office of the Town <br /> Assessor." <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Commission <br /> Explanation: The Massachusetts Department of Environmental Protection (D.E.P.) has recently <br /> promulgated changes to abutter notification protocols, which help to clarify the limits of abutter <br /> notification requirements for projects occurring in Land Under Water Bodies and Water Ways, <br /> on lots of 50 acres or more and Linear-shaped projects 1000 feet or more in size. This by-law <br /> amendment seeks to maintain consistency between the new D.E.P. and local Mashpee <br /> notification requirements. <br /> The Board of Selectmen recommends approval by a vote of 5-0. <br /> The Finance Committee recommends approval by a vote of 6-0, 1 absent. <br /> Motion made by Selectman Carol Sherman. <br /> Motion: I move the Town vote to approve Article 26 as printed in the Warrant, with the <br /> exception of the phrase "or take any other action relating thereto." <br /> Motion made and passed to dispense with reading of article at 8:22PM. <br /> Motion passes unanimously at 8:22 PM. <br /> Article 27 <br /> To see if the Town will vote to accept as public ways the layouts of Jonas Drive, Valerie Circle, <br /> and Rachelle Court as shown on plans entitled "Road Easement Taking Plan of Jonas Drive, <br /> Valerie Circle and Rachelle Court", in Mashpee, MA (Barnstable County) dated May 20, 2014, <br /> and prepared by Capesurv, which layouts shall have been filed in the Office of the Town Clerk <br /> not later than seven days prior to the date of vote hereunder, and to authorize the Board of <br /> Selectmen to acquire by gift, purchase, or eminent domain taking any land necessary for the <br /> purposes of such ways as so laid out, and to appropriate and transfer from available funds <br /> $322,024.50 to the Jonas Drive, Valerie Circle and Rachelle Court Roadways Account, and to <br /> raise said appropriation the Treasurer, with the approval of the Board of Selectmen, be <br /> authorized to borrow at one time or, from time to time, under and pursuant to Chapter 44, <br /> Section 7 or 8 or any other enabling authority, for such purchase or taking and layout, including <br /> costs of constructing such ways and legal financing, and other costs incidental and related <br /> thereto; and further authorize the Board of Selectmen to assess betterments to the owners of the <br /> land abutting the ways, or take any other action relating thereto. <br /> Submitted by Petition <br /> 26 <br />
