"In accordance with the provisions of§12(b) of said Chapter 30B, all such contracts may, in the <br /> discretion of the Town body or officer authorized to award same, be entered into for a period of <br /> up to five years, including any renewal, extension or option related thereto." <br /> Motion passes at 7:50 PM. <br /> Article 16 <br /> To see if the Town will vote that those parcels shown on the FY2013 Mashpee Assessors' Maps <br /> as Map 69, Block 18 (108 Orchard Road) and Map 69, Block 6 (68 Strawberry Avenue) shall not <br /> be held by the Town as conservation land; and further, vote that said parcels shall be transferred <br /> from the care and custody of the Custodian of Tax Foreclosed Property to the Board of Selectmen <br /> for the purposes of donation or sale to an entity or entities engaged in the development of <br /> affordable housing for sale or rental to persons of low or very low income within the meaning of <br /> the Housing Act of 1937, and qualifying for listing in the affordable housing inventory maintained <br /> by the Massachusetts Department of Housing and Community Development under G.L. Chapter <br /> 40B, with such transfer to be made subject to such terms as the Selectmen deem appropriate, <br /> including a permanent deed restriction, which may contain a reverter clause, permanently <br /> restricting the sale or resale price, or rental cost of any homes or apartments constructed on said <br /> parcels to no more than that considered affordable for persons of low income as defined by the <br /> U.S. Department of Housing and Urban Development and qualified for continued listing in the <br /> above affordable housing inventory; and, further,to authorize the Board of Selectmen to make use <br /> of any other instrumentalities of the Town or other agencies and to enter into any agreements <br /> necessary to effect the transfer and restriction of such land in accordance with this Article, or take <br /> any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: Approval of this article would authorize the Board of Selectmen to transfer title of <br /> two parcels of land identified as 108 Orchard Road and 68 Strawberry Avenue, previously taken <br /> by the Town for non-payment of taxes, to persons or agencies that would construct affordable <br /> homes or apartments. The lots would be developed with the approval of the Board of Selectmen <br /> pursuant to a Request for Proposals from interested affordable housing providers, as was done with <br /> a number of lots previously deeded by the Town to Habitat for Humanity, and would be <br /> permanently restricted for use for affordable housing. <br /> Board of Selectmen recommends approval by a vote of 5-0. <br /> Finance Committee recommends approval by a vote of 5-0; 2 absent. <br /> Motion made and seconded to dispense with reading of article at 7:51 PM. <br /> Motion made by Selectman John Cahalane. <br /> Motion: I move Article 16 be approved as printed in the Warrant,with the exception of the phrase <br /> "or take any other action relating thereto." <br /> Motion passes by 2/3`'d vote at 7:53 PM. <br /> 11 <br />
