MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 27,2019 <br /> Mr. Bonvie made a motion to issue a Variance to William and Christine Herbert of 42 <br /> Spoon Drift Way which is the same Variance outlined from a prior Variance (V-2017-01) <br /> issued by the Zoning Board of Appeals. Issuing this Variance the Board finds that all other <br /> requirements have been met to allow for construction of a detached garage on property <br /> located in an R-3 Zoning District, Map 111 Parcel 127, Mashpee, MA with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. Plot Plan — From BSS Design, Proposed Garage, Prepared for William and <br /> Christine Herbert, 42 Spoondrift Way, Mashpee, MA. Scale: 1"=20', Date: April <br /> 26, 2007, Drawn by: EJP, RAR, TJB, Job Number: 6172, Drawing Number: P 12- <br /> 115,Revisions: Added proposed planting and notes for Conservation,4/2/09, TJB. <br /> Increased planting,revised prop patio 5/14/09. There were no other revisions made <br /> to the plan. <br /> 3. The Board issues a Variance in the amount of 5 ft. from the side yard setback for <br /> construction of a detached garage, no heating, no bathroom, no toilet, no bath tub, <br /> no shower, and no living space above the proposed garage. <br /> 4. Conditioned that the homeowners submit a floor plan to the Board of Health to <br /> meet their approval, and also seek and obtain Conservation approval prior to <br /> submittal of a Building Permit application. <br /> 5. Conditioned upon all Town Department comments read into the record. <br /> Mr. Gould seconded, <br /> Mr. Blaisdell, yes, <br /> Ms. Sangeleer, yes, <br /> Mr. Furbush, yes. <br /> All were in favor to issue a Variance for a detached garage. <br /> 51 Massasoit Avenue: Owners, Gary D. and Claire L. Briggs request a Variance from the <br /> side yard setback, front yard setback, and lot coverage under §174-31 to allow for <br /> construction of a detached garage on property located in an R-3 Zoning District, Map 72 <br /> Parcel 45, Mashpee, MA. <br /> Attorney Kevin Kirrane represented the homeowners for their Variance request. Mr. <br /> Kirrane provided a plot plan,his written remarks,and a garage building plan. The plot plan <br /> depicts a 12,500 sq. ft. lot situated at the corner of Massasoit and Cappawack Roads and <br /> has been developed with a single-family residence. The applicants are .proposing to <br /> construct a modest, one car single-story garage which will be situated at the rear of <br /> Massasoit, and on the side from Cappawack. The proposed garage will be within 12 ft. of <br /> the common property line between lot 948 and the subject matter lot. <br /> 2 <br />
