MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 23, 2019 <br /> Mr. Gould seconded. <br /> Mr. Blaisdell, yes. <br /> Mr. Goldstein, yes. <br /> Mr. Furbush, yes, and <br /> Mr. Bonvie, yes. <br /> All were in favor of the house addition. <br /> CONTINUED HEARINGS <br /> 345 Monomoscoy Road: Owners, Carl and Kristen Cavossa request a Special Permit <br /> under §174.25.I (9) of the Zoning Bylaws to allow for reconstruction of a dock,pier,ramp, <br /> and float on property located in an R-3 Zoning District, (Map 120 Parcel 24), Mashpee, <br /> MA. <br /> Mr. Ken Breivogel, with J.E. Landers-Cauley, representing the applicants for a Special <br /> Permit for their dock. He said the hearing was continued from two weeks ago so the Board <br /> could obtain comments from the Shellfish Constable and the Harbormaster. The Shellfish <br /> Constable did submit a letter, and she mentioned that the applicant has made the necessary <br /> revised by removing four pilings. She also submitted a mitigation sheet to which Mr. <br /> Cavossa has agreed to pay the amount of$846. He believes that this letter is an approval <br /> of the project. The Harbormaster also submitted a letter but did not make any comments. <br /> He said that under the bylaw, the Board can accept this application as an approval if there <br /> are no further comments from the Harbormaster or Shellfish Constable. He requested that <br /> the Board approve the dock as applied. <br /> Mr. Furbush said he did receive the comments from the Shellfish Constable. He read the <br /> email sent from the Acting Harbormaster that he is looking into issues, and will not be able <br /> to submit any comments at this time. He asked Mr. Breivogel if he knew what the <br /> Harbormaster was referencing. <br /> Mr. Breivogel thought he might be looking at the dock to the North that Mr. Luckraft said <br /> was too long. He said that there is an issue with that dock. <br /> Mr. Bonvie asked how that dock affects this application. <br /> Mx. Cavossa, the homeowner said the only reason he is in front of the ZBA is because the <br /> dock is 79 ft. He pointed out on the plan that the dock extends out 48 ft.,has a Ib ft. ramp, <br /> and a 16 ft. float. His dock was approved by Conservation, and was told to proceed and <br /> build the dock. He applied for Chapter 91, and was told that he needed to visit with the <br /> Building Department, and apply with the Zoning Board because the dock is too long. He <br /> consulted with this engineer who suggested he shorten the ramp, and will be under the 70 <br /> ft. He said he applied with the ZBA, and thought it would be a simple process because it <br /> was already approved. He said he could shorten the ramp by 9 ft. He understands his <br /> neighbor is not happy, but he has approval from Conservation and the Shellfish Constable. <br /> 3 <br />
