MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 23, 2019 <br /> Mr. Furbush said he recalled that a line was drawn from the south and from the north of <br /> the dock in question,but now there appears that maybe one of these dock is not legal. <br /> Mr. Cavossa said that they are approved and licensed. If something was done illegal he has <br /> no knowledge of that. He is only trying to build his dock based on what was submitted to <br /> the Board that was approved by Conservation. <br /> Mr. Goldstein asked what his dock has to do with the abutter's dock. Mr. Furbush said it's <br /> such a narrow area. <br /> Mr. Bonvie said that if there are no comments from the Harbormaster, than we could <br /> possibly move forward. Historically, the Board has relied on both the Harbormaster, and <br /> the Shellfish Constable to provide their comments, and if they approve, the Board <br /> approves. But there's a question with the Harbormaster. <br /> Mr. Cavossa said that the letters that were read into the record at the last meeting were the <br /> letters submitted prior to the changes that he made to his dock. <br /> Mr. Furbush recommended that the hearing be continued because there's issues. Mr. <br /> Bonvie said that it might make sense to hear from the abutter. <br /> Mr. Luckraft, an abutter addressed the Board, and said that there were two meeting with <br /> the Conservation Commission,the first one was on March 8,2018 he read a letter from the <br /> Harbormaster that was read into the previous hearing. <br /> The Board asked Mr. Luckraft if there were any current comments. He passed out meeting <br /> minutes that were dated April 6, 2018 which is not what the Board asked for. <br /> Mr. Bonvie asked Mr. Luckraft what his specific concerns were with Mr. Cavossa's dock. <br /> Mr. Luckraft said he believes he is moving an additional 9-10 ft. into the water. He said his <br /> dock is right up against the edge of the river. He believes Mr. Cavossa will extend further <br /> into the river so he can bring in a larger vessel. <br /> Mr. Cavossa said that the dock to the north is a licensed dock and has been in existence <br /> since 2001. There has never been an issue. <br /> Mr. Mendoza said that the issue right now is regarding the Harbormaster. If the Board is <br /> waiting for the Harbormaster to respond he suggested that the applicant reach out to the <br /> Harbormaster and find out what the issue is that could affect the situation. <br /> Mr. Cavossa asked Mr. Furbush to respectfully withdraw his application for the Zoning <br /> Board of Appeals. <br /> Mr. Blaisdell said to Mr. Cavossa that he might want to rescind that request for two weeks, <br /> and then make that same request in two weeks. <br /> 4 <br />
