'C <br /> f`y' 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall.—Ockway Meeting Room <br /> Minutes of the Meeting of January 24, 2019 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel,Chair Laurel Almquist,Co-Chair Glen Harrington, Health Agent <br /> Mallory Langler,Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:02 PM. <br /> APPOINTMENTS <br /> 7:15—Show Cause Hearing—Thomas Silvia <br /> Mr. Harrington commented that a show-cause hearing was'scheduled for January 3, 2019 but that Mr. <br /> Silvia was hot available, and it was moved to this meeting. On September 12, 2018, Mr. Silvia Inspected <br /> the property at 20 Coombs Lane and submitted his septic inspection report. The report was reviewed and <br /> several violations of Title V and local board of health septic regulations were apparent. The violations <br /> were outlined in a letter to Mr. Silvia dated December 7, 2018. The result of the septic Inspection was a <br /> failure due to the soil absorption system being below groundwater elevation; however, no depth to <br /> groundwater or groundwater elevation was provided in the report. The system was ultimately failed after <br /> the soil absorption system was Inspected and confirmed by the Assistant Health Agent on November 30, <br /> 2018, <br /> Mr. Silvia was present at the hearing and introduced himself to the board. Chair Baumgaertel asked Mr. <br /> Harrington for additional Information and clarification on the matter. Mr. Harrington stated that he <br /> brought this matter before the board because of speculative and erroneous comments made by Mr.Silvia. <br /> Mr. Harrington stated that the inspection report had a lot of holes in it, and he was concerned with the <br /> number and types of violations it contained. He further stated that,when he spoke with Mr. Silvia,the <br /> inspector made several comments that suggested he had not done the inspection correctly or in .a <br /> professional manner. Chair Baumgaertel asked Mr.Silvia if he would like to comment,and the inspector <br /> responded that he does a lot of work with banks on foreclosures and that they don't want the liability for <br /> the old systems. Chair Baumgaertel asked how the inspector determined the water table on this system, <br /> and Mr. Silvia answered by the depth of the plumbing, and agreed that He may have misread the water <br /> table on this system. Mr.Silvia Informed the board that this was his first inspection in Mashpee. He stated <br /> that he Is not accustomed to seeing so much sand,and that everything is in the water table on the majority <br /> of jobs he does. Chair Baumgaertel asked if the system was In groundwater and Mr. Harrington answered <br /> that It was not. Chair Baumgaertel asked Mr.Silvia if he dug up the tank,and the inspector answered that <br /> it had a washing machine cover so he did not. Chair Baumgaertel advised Mr.Silvia that he did not do his <br /> homework on this job and did not go about the inspection the proper way. He cautioned Mr.Silvia that, <br /> . 1 <br />
