if the board allows him to continue to do work in Mashpee,the expectation would be that Mr.Silvia would <br /> perform thorough inspections and submit accurate reports that are reflective of the facts. Ms. Langler <br /> advised Mr.Silvia that,just because banks like to see systems upgraded as part of the turnover, does.not <br /> mean the system should automatically be reported as being in failure. Chair Baumgaertel asked Mr. <br /> Harrington if fines had already been issued and he answered no, but indicated that fines can be issued for <br /> a first offense. <br /> There being no further discussion or questions, Mallory Langler moved to issue a $100 fine to Thomas <br /> Silvia for this first offense. Motion seconded by.Brian Baumgaertel, VOTE; Unanimous (2-0). <br /> 7;20—Show Cause Hearing—Finally Dino's, Dino Mitrokostas <br /> Mr.Harrington commented that the food facility at Finally Dino's Pizza and Dino's Sports Bar had been on <br /> probation since June of 2018. Monthly food inspections were performed and critical and non-critical <br /> violations were found each month during the probationary period up to October. Two fines were issued <br /> for violations found during the July and August Inspections, and those fines were paid. The October <br /> inspection also found two critical and four non-critical violations. The two critical violations dictate a <br /> closure of the facility for a three-day period, per the Food Establishment Inspection and Enforcement <br /> Regulation. The board should be the entity to issue the suspension and closure. The permittee, Dino <br /> Mitrokostas, has the right to explain why he believes the suspension should be withdrawn. <br /> Mr.Mitrokostas was present at the hearing and Introduced himself to the board. Mr.Harrington reviewed <br /> the most prevalent violations, including the ice scoop in the open air bin in the bar, and uncovered food <br /> found on more than one occasion in different locations. Ms. Langler asked about the, hole in the <br /> bathroom, and Mr. Mitrokostas responded that someone had ripped the soap dispenser off the wall the <br /> previous night but that it had been promptly repaired. Ms.Langler asked who holds the ServSafe and Mr. <br /> Mitrokostas answered that he holds It, but there are other employees who are certified as well. Ms. <br /> Langler then asked if he Is there during all food service hours and Mr. Mitrokostas answered "pretty <br /> much". Chair Baumgaertel asked If there are ServSafe certificates on file In the Board of Health for other <br /> employees and Mr. Mitrokostas answered in the affirmative, but Mr. Harrington corrected him, stating <br /> that the only certificates we had were for Mr.Mitrokostas, Ms.Langler asked If the other employees were <br /> food handlers or food safety managers and Mr. Mitrokostas responded that they had taken the full class. <br /> Ms.Langler advised Mr.Mitrokostas that,if the establishment is consistently cited for the same violations; <br /> it is going to weigh heavily on the outcome of the public hearing. Mr. Mitrokostas responded that he has <br /> been open 10,719 days,and has not had a problem until this past year,citing personal reasons. He went <br /> on to explain to the board about the use of hanging ice scoops versus the steel cups his bartenders have <br /> become accustomed to using in their bins, stating that the more Important issue Is that the bartenders <br /> don't use their hands or put glasses directly into the ice bins. Ms. Langler stated that she is equally <br /> concerned about violations related to.cleanliness and food debris. She stated that Mr. Mitrokostas was <br /> not brought before the board for one bad Inspection, but for inspections that consistently show critical <br /> violations. Mr,Mitrokostas continued to state that he has been in business for 40 years,and insisted that <br /> the violations were explainable and not that serious. Chair Baumgaertel Informed Mr. Mitrokostas that <br /> the point of the hearing was to put a stop to these violations before they escalated to a more serious level. <br /> Chair Baumgaertel stated that there are expectations for public health,and it is the board's job to ensure <br /> everyone operates to a certain standard. In this case,the board wants to make certain Mr. Mitrokostas <br /> understands there are issues that need to be addressed and things that need to be cleaned up at his <br /> establishment. Ms.Langler stated that she was glad Mr.Mitrokostas had additional food safety managers, <br /> but suggested that his staff may need re-training. She asked If Mr.Mitrokostas does any annual refresher <br /> 2 <br />
