He stated that the
board had continued this variance request hearing so that the engineer could speak with the Department
of Environmental Protection (DEP) regarding the depth of the Soil Absorption System (SAS) and the
current DEP approval for the RUCK filter. The engineer had since learned that his approval was for
residential properties only, and he needed to apply for piloting approval for use on commercial properties.
The plan was revised to include a pump chamber and to reduce the size of the SAS by 50%. The engineer
had indicated to Mr. Harrington that the reduction in size and type of the SAS was based upon the Piloting
Approval by DEP, but the technology has not been approved for Piloting yet, The second pump chamber
was added to keep the proposed SAS within three feet of grade.
Michael McGrath,of Holmes and McGrath, introduced himself as representingthe applicant, He indicated
that he would apply to DEP for site-specific approval, and that DEP told him it would take less than 90
days for Piloting Approval. Mr. Harrington stated that, technically, the board cannot approve the 50%
reduction of the SAS when the DEP Piloting Approval has not yet been granted.
Chair Baumgaertel stated that,if the board is going to approve the 50%reduction of the SAS,they would
want to see a reserve area in place. He indicated to Mr. McGrath that they are aware the RUCK system
performs well, but it is their responsibility to operate out of an abundance of caution. Mr. Harrington
advised the board that they have not previously varied that requirement for new construction.
1
