1 . TO SEE IF THE TOWN WILL VOTE TO ACCEPT MGL CHAPTER 90B- <br /> SECTION 1-19 ,AND 323CMR, SECTIONS 2 AND 4 OF THE STATE LAWS <br /> AND REGULATIONS AS THEY NOW STAND OR SHALL BE AMENDED, WHICH <br /> SHALL BE ADDED TO THE TOWN OF MASHPEE BYLAW CHAPTER 170 . <br /> f EXPLANATION: THE PURPOSE OF THIS CHANGE IS TO BRING MASHPEE <br /> BY-LAWS INTO AGREEMENT WITH THE STATE LAWS. THAT WILL ALLOW <br /> US TO WRITE CITATIONS VIOLATION OF THE LAW ON TOWN TICKETS <br /> AND THE PROCEEDS WILL ACCRUE TO MASHPEE RATHER THAN THE <br /> COMMONWEALTH. <br /> 2. TO SEE IF THE TOWN WILL VOTE THAT: THE HARBORMASTER AS <br /> HE DEEMS NECESSARY SHALL WRITE AND PUBLISH REGULATIONS, <br /> APPROVED BY THE BOARD OF SELECTMEN. THE RULES AND <br /> REGULATIONS SHALL BE ENFORCED BY THE HARBORMASTER AND <br /> ASSISTANT HARBORMASTERS. IN THE EVENT THAT ANY PROVISION OF <br /> THIS CHAPTER IS HEREAFTER FOUND TO BE INVALID, IT SHALL NOT <br /> AFFECT THE VALIDITY OF THE REMAINING PORTIONS OF THIS <br /> CHAPTER. <br /> EXPLANATION: THIS CHANGE WILL PROVIDE A SEVERABILITY CLAUSE <br /> IN THE BY-LAW WHERE AT PRESENT THERE IS NONE. <br /> 3. TO SEE IF THE TOWN WILL VOTE TO ACCEPT THE FOLLOWING <br /> DEFINITIONS, AND ADD THEM TO SECTION 170 OF THE MASHPEE <br /> BYLAWS. <br /> A. MASHPEE WATERWAY OR WATERWAYS - INCLUDES ALL OF THE <br /> NAVIGABLE WATERS WITHIN THE BOUNDARIES OF THE TOWN, WHICH <br /> SHALL INCLUDE ALL HARBORS, RIVERS,BAYS, OR PONDS,INCLUDING <br /> "WATERWAY (S) " WHICH FROM TIME TO TIME MAY BE TEMPORARILY <br /> NON-NAVIGABLE BY REASON OF LOW TIDE, DROUGHT OR SEASONAL <br /> WEATHER AND WATER CONDITIONS. <br /> B. HARBORMASTER - THE HARBORMASTER,AND ASSISTANT <br /> HARBORMASTERS DULY EMPOWERED BY THE GENERAL LAWS OF THE <br /> COMMONWEALTH. <br /> C . PERSONS - INCLUDES INDIVIDUALS, CORPORATIONS, <br /> SOCIETIES , ASSOCIATIONS , PARTNERSHIPS AND TRUSTS. <br /> EXPLANATION: THERE ARE NO DEFINITIONS IN THE CURRENT VERSION <br /> OF CHAPTER 170 , SO THIS CHANGE WILL DEFINE TERMS THAT MIGHT <br /> OTHERWISE BE SUBJECT TO MISINTERPRETATION. <br /> 4 . TO SEE IF THE TOWN WILL VOTE TO TRANSFER FROM AVAILABLE <br /> FUNDS THE SUM OF $15,000 TO BE USED FOR THE PURPOSES OF <br /> PERMITS , ENGINEERING, DREDGING, AND OTHER WATERWAYS <br /> IMPROVEMENT PRQ7ECTS IN MASHPEE. <br /> EXPLANATION: DUE TO NORMAL SEDIMENTATION, THE PREVIOUSLY <br /> DREDGED CHANNELS IN WAQUOIT AND POPPONESSET BAYS WILL NEED <br /> DREDGING SOON . TO DO THAT, THE PERMITS THAT HAVE EXPIRED <br /> NEED TO BE RENEWED, AND THAT WILL REQUIRE PROFESSIONAL <br /> ENGINEERING SERVICES. <br />
