`° "... <br /> °r Town of Mashpee <br /> ........... .n� <br /> y...9 <br /> 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall — Ockway Meeting Room <br /> Minutes of the Meeting of March 21, 2019 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel, Chair Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Mallory Langler, Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:04 PM. <br /> APPOINTMENTS <br /> Chair Baumgaertel requested to resume discussion on a matter which had been previously continued to <br /> this meeting but was inadvertently left off the agenda. <br /> There being no discussion or comments, Mallory Langler moved to add the Septic Inspection Regulation <br /> Variance Request for 65 Amos Landing Road to the agenda. Motion seconded by Laurel Almquist. VOTE: <br /> 3-0. <br /> Glen Harrington commented that the specific variance requested was from Board of Health Regulation, <br /> Part 9,Section 17(d)(1),which states that repairs to a system must be completed prior to a property being <br /> sold. In this case, a septic inspection revealed that repairs were needed, and the owner was requesting <br /> to sell the property as is and have the buyer take responsibility for repairs. To mitigate the requested <br /> variance, an Enforceable Agreement is required. <br /> Joe Gormely introduced himself to the board and stated that the property had already transferred to him <br /> on February 26, 2019. His lender had required that they fully fund repair of septic in advance.' He had <br /> already given a 50% deposit to B & B Excavation to complete the repair, and they were just waiting for <br /> asphalt plants to open for the season. <br /> Mr. Harrington advised the board of the nature of the repairs. He stated that they would typically set a <br /> date by which repairs had to be completed, normally 90 days from the date of transfer, but that could <br /> vary depending on the intended future use of the property. Mr. Gormely stated that the property would <br /> get very seasonal use until cosmetic renovations were complete, and he was looking to act on repairs as <br /> soon as possible. <br /> There being no further comments or discussion, Mallory Langler moved to approve the variance request <br /> for 65 Amos Landing Road contingent on submission of an Enforceable Agreement stating that repairs <br /> 1 <br />
