Review and Discussion of Proposed Rental Property Bylaw. <br /> Mr. Harrington commented that the Finance Committee supported the Rental Property Bylaw,an <br /> indication that they want the rental properties registered and inspected, but they did not support <br /> the additional position for a full-time Assistant Health Agent to perform the inspections. Mr. <br /> Harrington had previously sent comments to Chair Baumgaertel for review prior to submitting to <br /> the Town Manager to read into the record at Finance Committee meeting. He advised the Board <br /> that,since both articles were submitted by the Board of Health,health agents and board members <br /> would have to be prepared to publicly justify and support them at Town Meeting. He stated that <br /> the Selectmen would set the fees for the permits, but he did provide them with <br /> recommendations. <br /> Ms. Langler discussed Host Compliance as an option for out-sourcing the research related to <br /> rental properties. She did not have any prices yet, but indicated that they provide a wide range <br /> of services with everything being a la cart. She stated that the County had also spoken with Host <br /> Compliance about a possible County Package, if enough towns are interested, but expressed <br /> concern that towns would not be able to tweek a larger program to their specific needs. <br /> Ms. Langler indicated that her office has seen an increase in voluntary calls about the <br /> requirements for rental properties because of the new state code. Mr. Harrington stated that <br /> realtors are also calling with questions. Ms. Langler shared information she had on how Boston <br /> is handling the rental properties,stating that their permit fees were lower than she expected, but <br /> that it seemed to be working out very well for them. Mr. Harrington stated that Boston is not <br /> dealing with Title V, so they don't have to do bedroom research. Mashpee has many rental <br /> properties that are overinflating their capacity, which means health agents would be addressing <br /> sanitary code and bedroom issues. He stated that some health agents have said that an entire <br /> department could be created and justified solely to conduct rental property inspections. <br /> Chair Baumgaertel asked if the Selectmen are in favor of the new position, and Mr. Harrington <br /> answered that the Town Manager supported the article; however, the Selectmen had not yet <br /> executed the Warrant. Ms. Langler asked if the new position could be a contract position and <br /> Mr. Harrington answered that it had to be a union position. He stated that he did not have the. <br /> language used in the Warrant article for the new position, but that the request was for$56K salary <br /> and$96K with benefits,which would be offset by permit fees collected and a portion of the rental <br /> property tax. The permitting process itself would be fairly straightforward with the new online <br /> permitting system. Chair Baumgaertel expressed that this was going to require a lot of <br /> enforcement and they did not currently have the staff for it, so the board should be prepared to <br /> make a strong argument for the position. Mr. Harrington stated that, on a complaint basis,there <br /> is not a compelling argument for additional staff; however, in the interest of public health and in <br /> fairness to the hotels, motels, and other short-term lodging that we inspect and receive money <br /> from, it is better to be consistent and to perform these inspections. <br /> Mr. Harrington reminded the board that, under the bylaw, the definition of rental property <br /> includes seasonal, daily, weekly, and monthly rentals only.
