There being no further comments or discussion, Mallory Langler moved to approve the Nitrogen <br /> Aggregation Plan for Lots 2A and 2B Falmouth Road,also known as 829 and 835 Falmouth Road, provided <br /> the Grants of Title V Restriction and Easement are finalized and recorded at the Registry of Deeds, with <br /> an executed stamped copy provided to the Board of Health prior to issuance of the septic installation <br /> permit and approval of the Building permit. Motion seconded by Laurel Almquist. VOTE: Unanimous (3- <br /> 0). <br /> 7:25—73 Bluff Avenue <br /> Matt Costa commented that 73 Bluff Avenue is located in Popponesset and currently has a three-bedroom <br /> system, but is deed restricted to one bedroom. He is proposing to transfer credits to the property so it <br /> can be properly calculated for three bedrooms. The credit property is within the same Zone II and suitable <br /> upland area, and will have the required restriction on it. <br /> Mr. Harrington asked if Mr. Costa had the reference for the one-bedroom deed restriction, and advised <br /> the board they will have to rescind/release that deed restriction if they approve the proposed Nitrogen <br /> Aggregation Plan. Mr. Costa suggested the board write that into the approval letter and include it with <br /> the other recorded documents. Mr. Harrington recommended the approval letter cite the old restriction <br /> and what the new restriction would be. <br /> There being no further comments or discussion, Mallory Langler moved to rescind the current deed <br /> restriction for 73 Bluff Avenue and record the board's decision letter at the Registry of Deeds. VOTE: Unanimous (3-0). <br /> 7:30—73 Nick Trail <br /> Mr. Harrington commented that the existing Soil Absorption System(SAS)at 73 Nick Trail failed inspection <br /> due to lack of four feet to groundwater. The proposed system requires two variances: 1) a reduction in <br /> the depth to adjusted groundwater and; 2) a reduction in the setback to the foundation wall. A retaining <br /> wall is required due to the SAS being above existing grade. Denitrification is not typically required in this <br /> area as groundwater discharges to Nantucket Sound,which is not a nitrogen-impaired body of water. <br /> Carmen Shay, of Shay Environmental Services, introduced himself to the board, and stated that he had <br /> done everything he could to reduce the profile of this system, and to get it as high above the water table <br /> as possible, but that he needed a 1' reduction from the bottom of the SAS to the adjusted groundwater <br /> table and a reduction in the setback to the foundation wall from 20' to 12', and 7' to the bulkhead. Mr. <br /> Shay stated that there were no resources to be concerned about other than groundwater, and the <br /> groundwater information is very conservative. <br /> Mr. Harrington had concerns about the infiltrator chamber sinking, and recommended geogrid be used <br /> instead of filter fabric under the chambers. He advised the board that there were no private wells in the <br /> area but the property is in a Zone II. Chair Baumgaertel noted that a locus, as well as the liner elevation, <br /> was missing from the plan, and Mr. Shay agreed to provide an updated plan. In most situations where <br /> 3 <br />
