MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 8,2019 <br /> OTHER BUSINESS <br /> Informal Requests: <br /> 123 Tide Run: Steve Cook, Cotuit Bay Design to discuss the revised site plan regarding <br /> the approved Variance, Case No.: V-2019-19. <br /> Steve Cook, Cotuit Bay Design represented the current owners. The Board issued a <br /> Variance on March 27, 2019, and the application was heard at the Conservation meeting <br /> the following day, and it was determined that the area to expand the deck was previously <br /> designated as a planting area when the house was constructed. The owners were not aware, <br /> and did not complete the project for the order of conditions and certificate of compliance. <br /> Conservation would not approve the expansion towards Jehu Pond. So that project was <br /> abandoned, and the homeowners decided to expand the deck over the existing patio with <br /> the new plantings. This change is not getting any closer to Jehu pond, and just filling in the <br /> section of the deck and stairs over the existing patio. The lot coverage changed slightly. <br /> The Board requested that if there were any changes to the plan,would require the submittal <br /> of a revised plan. The original plan dated 4/11/18 is null and void. The revised plan had a <br /> revision date of 4/11/19. <br /> Norman asked if the project was approved by Conservation. Steve said an order of <br /> conditions was issued, and said that the plantings need to be installed. <br /> Chairman Furbush polled the Board and determined it's an administrative change,and does <br /> not affect the approved Variance. Mr. Furbush would like to confirm that the revision date <br /> on the plan can be approved, and to confirm that the administrative approval made by the <br /> Board is sufficient with the Building Commissioner. The Board read the Town Department <br /> comments into the record. <br /> 351 Monomoscoy Road: Tim Luff, Archi-Tech Associates to discuss §174-45.4 <br /> Accessory Apartments, Item C as it pertains to the location of a proposed accessory <br /> apartment. <br /> Mr. Tim Luff, Archi-Tech Associates provided the Board with a plan. Also present were <br /> Richard and Barry Sahl,the owners of the property.Mr. Luff had a conversation with Mike <br /> Mendoza to get a better understanding of the accessory apartment bylaw as it relates to the <br /> unit size. Mr. Luff brought a list of questions to ask the Board. His original thought was to <br /> perhaps build onto that garage and put in the apartment and connect the garage to the house. <br /> He asked Mike what would satisfy a connection of the garage to the house. Could the <br /> connection be a breezeway that's open, or would the connection have to be something that <br /> is enclosed and has an entry. Mike referred him to the ZBA and was not comfortable to <br /> answer that question.Mr. Luff knows that a formal application to the ZBA will be required, <br /> and he will provide sufficient plans. He reviewed the bylaw requirements with the Board. <br /> 4 <br />
