Board of Selectmen
Minutes
June 3, 2019
APPOINTMENTS & HEARINGS
Public Hearing—Request for Modification of Entertainment License: Naukabout Beer Company LLC: Peter
Murner:
Acting as the Licensing Authority for the Town of Mashpee, the Board of Selectmen opened the Public
Hearing to consider the possible modification to the entertainment license of Naukabout Beer Company LLC
d/b/a Naukabout Beer Company, LLC. To conform to posting procedures, the Public Hearing notice was read
aloud into the record.
Peter Murner co-owner and general manager of Naukabout Beer Company LLC 13 Lake Avenue, Mashpee
was in attendance to discuss the possibility of modifying the current entertainment license to allow the
brewery to host live, amplified music on their outdoor patio.
Mr. Murner indicated that live music has always been his goal. After being in operation for one year with a
good handle on the business this type of offering would ensure continued success and allow the brewery to
attract new visitors and remain competitive.
Outdoor music without amplification is currently permissible in the Town of Mashpee. The permit also
allows for pipe music and basic radio. Licenses approved by the Board of Selectmen for entertainment
prohibit outdoor amplification. Since the Selectmen's determination to cease outdoor amplification, there
have been no issues. This includes the absence of late night noise disturbances. There is concern as the
Naukabout Beer Company is situated adjacent to a pond, and sound tends to travel over water.
It was agreed it is difficult to be selective in terms of entertainment licenses. It is also difficult to gauge and
control amplification outdoors. Mr. Murner indicated he would conform to perimeters, and would agree to
have no amplified music outdoors in the evening. The brewery generally closes at 9:00 p.m. During the
summer the establishment may close at 10:00 or 11:00 p.m. Most of the business is conducted during daytime
hours.
Outdoor music with amplification would mainly consist of one guitar player with two to three guitar players
maximum.
Town Manager Rodney C. Collins indicated the proprietor of the Naukabout Brewery has been very
responsible to the Board of Selectmen and to the Town of Mashpee. With the Selectmen's approval Town
Manager Collins agreed to work with Town Counsel to develop restricted language regarding terms and
conditions, and return to the Board with a recommendation.
The 2019 Entertainment License of Naukabout Beer Company is stipulated as follows; Amplification
permitted indoors only. Outdoor entertainment restricted to acoustic music with no live amplified music and
no disc jockeys. Outdoor patio closes at 10:00 p.m.
4
