Town of Mashpee
16 Crest 1Veck Ap ad JVor7h
Aloshpee;Vasstachusetts 02649
Conservation Commission Minutes
Thursday, May 23, 2019
Mashpee Town Hall
Waquoit Meeting Room
Present: Dale McKay, Brad Sweet, Tom O'Neill, Charles Dalton, Chad Smith and Marty
Bregman
Also Present: Conservation Agent Andrew McManus and Judy Daigneault, Recording
Secretary
CALL MEETING TO ORDER: 6:00 p.m.
Chair Dale McKay opened the meeting at 6:00 p.m.
PRE/POST-HEARING AGENDA:
Public
Patrick Knight, 39 Little Neck Lane stated the reason he was at the meeting is that last fall he
was before the Conservation Commission for and was granted approval to add a privacy hedge.
He showed pictures of what it ended up looking like. This spring .his neighbor at 43 added a
project and he was surprised to see a 4-foot retaining wall was added. He asked the
Conservation Commission if he could add some more bushes because they no longer have any
privacy. The Chair stated the Commissioners cannot take any action tonight because the
request would need to be on the agenda.
The Agent stated the request is at the discretion of the Commissioners if it requires a permit or
not. There isn't any issue as far as any impact on any resource areas which is within the 100-
foot setback so it is more than 50 feet away than the coastal bank. He said we would still
document it as far as what is permitted so we have the paper trail. Mr. Knight said they would
use similar plants that are already there, maybe six or eight. There was a discussion on how to
proceed. The Agent stated he could contact the neighbor to make sure there isn't any issue.
There was concern the abutters were not notified. The Agent noted the Commissioners cannot
take a vote tonight because it was not on the agenda which has to be 48 hours prior to the
meeting.
Mr. Knight stated his second question is regarding the runoff from the retaining wall. He is
concerned about the drainage coming right to his house. The Agent stated he would check with
the engineer to find out the details of the retaining construction and the possibility of runoff. He
said last he heard was the engineer was preparing an amended order of conditions for 43 Little
Neck Lane.
