Town of Mashpee <br /> y' 16 Great Neck Road North <br /> �y �DLG CQ'�ty Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall —Waquoit Meeting Room <br /> Minutes of the Meeting of June 6, 2019 <br /> Board Members Present: Member Absent: Aliso Present: <br /> Brian Baumgaertel, Chair Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Mallory Langler, Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:01 PM, <br /> APPOINTMENTS <br /> Appeal of Tobacco Violations <br /> Glen Harrington commented that,on April 23,2019,a tobacco compliance check by the Cape Cod Regional <br /> Tobacco Control Program identified several violations of the Board of Health Tobacco Sales Regulation at <br /> three establishments— Mashpee Country Store, The Barn and Mashpee Shell, On May 15, 2019, order <br /> letters were sent to each of the named establishments, outlining the violations and imposing a fine of <br /> $100.00, per the regulation. <br /> The owners of the establishments have requested that the board reconsider the fine and violation; <br /> specifically, they do not want to have a formal strike/violation against them. The legal process for the <br /> appeal of a violation is to submit a complaint in Superior Court; however, in an effort to limit Town <br /> Counsel's time and the Town's money, this matter was placed on the agenda so the board may resolve <br /> the request without court costs. <br /> On January 8,2019, Bob Collett of the Cape Cod Regional Tobacco Control Program and Health Agent met <br /> at the Route 130 Shell to train the owners regarding the new flavored tobacco restricted products. The <br /> owners of Mashpee Shell,Mashpee Country Store,and Commons Convenience attended the training. The <br /> owner of The Barn was not in attendance. At the training, the sale of cigars and flavored products, and <br /> the restriction of the Fronto King leaves was discussed. Fronto King cigars were not discussed,therefore, <br /> the shop owners were not aware of that. The training covered a tremendous amount of material <br /> regarding all types of product. <br /> 7:15—Mashpee Country Store. <br /> Mr. Harrington advised the board that Mashpee Country Store sold Fronto leaves,which are considered <br /> blunt wraps. <br /> 1 <br />
