Mohammad Rafique of Mashpee Country Store stated his name for the record. He explained that he <br /> simply misunderstood the restriction regarding the leaves, Mr. Harrington explained to the board that, <br /> while Fronto leaves were discussed atthetraining,there are also Fronto cigars,which are looselywrapped <br /> leaves. He believes that education should come first, with enforcement to follow. Mr. Collette did not <br /> advise Mr. Harrington that the Fronto cigars are considered blunt wraps until after the training had <br /> concluded. Neither the Fronto leaves nor the cigars are on the MAHB list. <br /> Chair Baumgaertel agreed that this was likely a misunderstanding, but wanted to be clear that it was in <br /> relation to the cigars only. The remaining board members were in agreement. <br /> There being no further comments or discussion, Mallory Langler moved to waive the $100 fine and to <br /> rescind the violation for Mashpee Country Store, 387 Main Street, regarding the tobacco compliance <br /> check on April 23,2019. Motion seconded by Laurel Almquist. <br /> Chair Baumgaertel expressed concern that, if the board rescinds the violation and there is another one at <br /> this location, they would have to consider the new violation to be the first. Mr. Harrington stated that <br /> the tolling period is 48 months,and suggested the board rescind the fine on the condition that any further <br /> violation within 12 months would result in reinstatement of this violation. <br /> Mallory Langler moved to amend the previous motion to add the condition that there be no other <br /> violations within 12 months of April 23,2019, If there Is a violation,the violation and fine of April 23,2019 <br /> would be reinstated. Motion seconded by Laurel Almquist. VOTE: Unanimous (3-0)on original motion, <br /> VOTE: Unanimous (3-0)on amendment. <br /> 7:20—The Barn. <br /> Mr. Harrington advised the Board that, in the case of The Barn, there were two violations, Fronto King <br /> blunt wraps were sold and two types of flavored cigars were sold, Black & Mild Jazz Cigars are on the <br /> MAHB list provided to the retailers. <br /> Mohammad Shafique,from The Barn,stated his name for the record. He asked board members If it made <br /> sense that he would knowingly remove all but two of the flavored products from his shelves. He explained <br /> that many flavors were taken off the shelves,and this was simply an oversight. Mr. Harrington explained <br /> to the board that the list of flavored products provided by MAHB is 34 pages long. <br /> Mansoor A. "Java",from Mashpee Shell,stated his name for the record. •He stated that he requested the <br /> training at his establishment so that the retailers could gather in one place and learn about all of the <br /> different products. He explained his confusion surrounding the Fronto King products. He also <br /> misunderstand that two cigars, even if sold together in one package, cannot be priced less than $5, He <br /> let the board know that, as soon as the violations were brought to his attention, he corrected them on <br /> the spot, <br /> Chair Baumgaertel agreed that the cigar pricing was understandable and likely an honest mistake, and <br /> Ms. Langler stated that she would be amenable to similar terms as Mashpee Country Store <br /> There being no further comments or discussion, Laurel Almquist moved to rescind the violation and$100 <br /> fine from April 23, 2019 for The Barn,at 22 Falmouth Road. If there is nbn-compliance within 12 months, <br /> the violation and fine would be reinstated. Motion seconded by Mallory Langler. VOTE: Unanimous (3- <br /> 0). <br /> 2 <br />
