forward,and board members agreed that existing systems should continue operating under their <br /> original approvals. <br /> Ms.Almquist asked if"seasonals"were being looked at any differently than year-round systems, <br /> and Mr. Harrington answered that all systems should be maintained as though they were year- <br /> round systems. <br /> Board members were in agreement that there is no need for a contract for the effluent t-filter, <br /> with there being no way to enforce compliance on that. It was agreed that an annual inspection <br /> is adequate for pressure distribution, and further agreed that those inspections should be <br /> performed by a Class II Treatment Plant Operator. <br /> In anticipation of the public hearing, Mr. Harrington will prepare the final regulation, advertise <br /> the hearing date, and notify engineers and installers. <br /> 2. Review of Marijuana Regulation post review by Town Counsel. Mr. Harrington commented that <br /> Town Counsel reviewed the regulation and had the following two comments: 1)there cannot be <br /> a cap set on the number of marijuana establishments,therefore,the first sentence in Section E.12, <br /> which set the cap at 10, had to be deleted; and 2) Counsel commented on the fees again, which <br /> the board has previously reviewed and upheld. <br /> Staff review of the regulation revealed a discrepancy between permitting of RMDs (medical) <br /> versus permitting of marijuana establishments; the definition of"agents"—an agent of an RMD <br /> or marijuana establishment, or a "municipal" agent which was changed to "Board of Health" <br /> agent. Definitions for each are listed in the definitions section, and are now more clear which <br /> applies in each case. <br /> Mr. Harrington advised the board of some additional changes that were included in the version <br /> dated April 25, 2019, which were as follows: 1) the Board of Health has no direct oversight on <br /> RMDs, so most of the references to medical facilities were removed; 2) the word "either" was <br /> removed from Section E.6; and 3) the retail food fee was increased from $40 to $100 in Section <br /> E.6,to be consistent with our retail food fee. <br /> Mr. Harrington also recommended that board members designate "Board of Health Agents" as <br /> the Board of Health Director and staff, Police Department officials, Fire Department officials, and <br /> code enforcement officials to include the Building/Zoning/Planning Departments. <br /> There being no further comments or discussion, Mallory Langler moved to approve the draft <br /> Marijuana Regulation version from April 25, 2019, with the following conditions: 1) the word <br /> "either"is removed from Section.E.6;2)the retail food fee is increased from$40 to$100 in Section <br /> E.13; and 3)the"Board of Health Agents"are designated as the Director of Public Health and any <br /> Town employee that may be designated by the Board of Health, which may include Board of <br /> Health staff, law enforcement officials, fire officials and code enforcement officials. Motion <br /> seconded by Laurel Almquist. VOTE: Unanimous(3-0). <br /> NEW BUSINESS <br /> 1. Approve Board of Health Meeting Minutes.
